PURPOSE: APPROVE SPECIAL EVENT / CLINT LAIRD-CALVARY
SONRISE/UTILIZE LEACH AMPHITHEATER FOR THE VISION
OF THE HEARTLAND / AUGUST 28, 2020 (STAFF
RECOMMENDS DENIAL OF PERMIT)

NOW, THEREFORE, BE IT RESOLVED, by the Common Council of the City of
Oshkosh that approval is granted to Clint Laird/Calvary SonRise(Mike Braun)to utilize the
Leach Amphitheater Friday, August 28, 2020 for the Vision of the Heartland event, in
accordance with the municipal code and the attached application, with the following
exceptions/conditions:
A. Follow recommendations provided by the Winnebago County Health
Department which include, but are not limited to: social distancing, hand
sanitizing stations, cleaning/disinfecting frequently used surfaces,eliminating
exchange of cash, and proper handling of food and beverages.

BE IT FURTHER RESOLVED that as a condition of approval, the Event Organizer
shall pay the City's actual costs for extraordinary services. Approval of this request shall
not be interpreted as approval to conduct the event during any period of emergency order
or declaration prohibiting such event. Approval of this event shall not be interpreted to
supersede any emergency order or declaration applicable to such event and all events
shall remain subject to all applicable ordinances, orders, declarations and requirements
for public gatherings.

SUBJECT. Approve Special Event— Clint Laird/Calvary SonRise to utilize the Leach
Amphitheater for the Visions for the Heartland event/August 28, 2020 (Staff
Recommends Denial of Permit)
BACKGROUND
On March 9, 2010, the Common Council adopted a Special Events, Marches, and Public
Assemblies Ordinance (Article III, Section 5-18) which allows the City Manager to recommend
approval or denial to the Common Council of Special Event Permits. As stated in the Ordinance
(Section 5-18, I), during the review of the application, the City will address traffic and parking
issues, health and safety issues related to the participants and to the public, effects upon
neighboring property, fire potential, explosions, disorder and other dangers to persons or
property, prostration of peace and order, sanitation and the overall safeguarding of the public.
Based on Section 5-18,VI(D), a permit may be denied, or conditions placed thereon,based upon
consideration of the health, safety, and welfare of the community, and of the anticipated costs
of holding such event. Additionally, as indicated in this section, the Common Council may base
their decision on the intended Special Event use or activity would present a grave or
unreasonable danger to the health or safety of the person expected to participate in the event,
the neighborhood in which the event will occur, the community as a whole, or City property
and resources required to be involved with the proposed event.
ANALYSIS
The City recently received an application submitted by Mike Braun on behalf of the Clint
Laird/Calvary SonRise. Mr Braun is requesting to host a Festival/Music Concert at the Leach
Amphitheater on Friday, August 28, 2020 The event would include: music; food and beverage
sales; non-food related sales; and a tent. Mr Braun stated the expected attendance could be
1,000 to 3,000 people and the event is free and open to the public.

According to the Winnebago County COVID-19 recommendations, found on the Winnebago
County Health Department website, they continue to recommend individuals: increase
standards of facility cleaning and disinfection of all areas;provide and encourage face coverings
and PPE, provide signage for and encourage good hand hygiene; screen individuals for illness
and have sick people stay home; avoid gatherings of 10 or more people or any gathering for
which you cannot maintain physical distancing of at least six (6) feet between people not
residing in a single living unit or household, avoid situations where you are unable to exercise
appropriate physical distancing with non-household members; consider cancelling or
postponing events of gatherings of more than 10 people.
In Oshkosh, we know that the number of confirmed coronavirus cases has been on the rise the
past few weeks and many of these cases can be traced to gatherings of people outside their
household, placing the community at greater risk for transmission. We anticipate this will
continue following the July 4th holiday and the many large group gatherings that took place.
Allowing a large group event that is expected to attract 1,000-3,000 people at a city-owned venue
is something I cannot recommend at this time. We are aware that many of the new confirmed
cases involve individuals that have attended live music events where they need to speak louder
and closer in order to be heard. This compounds the potential of transmitting the virus.
Additionally, this is the exact reason why nearly all large events, including outdoor music
concerts, have canceled their events for this year
RECOMMENDATION
Although Mr Braun has provided information stating their organization would add sanitizing
stations at entry points and attempt to mark 6' areas to allow for social distancing, I do not
believe that this can be adequately maintained during a festival/music concert.
With the numbers of positive COVID-19 test results continuing to rise, City staff believes it
would be irresponsible for us to approve an event at a city-owned venue that is expecting to
bring thousands of individuals into a confined area where social distancing would become
challenging. We need to do our part to protect the health and public safety of our citizens and
our community
For these reasons, I recommend denial of the Special Events Permit for the Vision for the
Heartland event.
