That Section 2-16(E), 2-24, 2-32(A)(2), 2-360), 2-51(B)(1), 6-17(A), 7- 32(A)(4), 7-33, 8-43(IV)(k)(i), 8-79(B), 16-10(A),(G), and (M), 16-15(A)(1)(d) and (g), 16- 15(A)(2)(c) and (f), 16-15(A)(3), 16-17, 16-22(A)(3),(10),(11),(13),(14) and (17), 16-25, 16- 33(A)(5), 16-51(A)(5), 17-2(B)(1), 17-3(B)(21), 19-7.1(C)(1)(e)(2), 20-8(C)(3)(a) and (b), 27A- 10.1 and 27A-11 are hereby amended to read as shown on the attachment to this ordinance. SECTION 2. That Section 16-10(C), (F), 0), (K), and (P), 16-12.1, 16-15(A)(2)(d), and 19-4(J) are hereby repealed. SECTION 3. JUNE 23, 2020 JULY 14, 2020 20-290 20-319 ORDINANCE FIRST READING SECOND READING The ordinance revises various sections of the municipal code to remove outdated references to departments/divisions, remove or amend outdated or revised code references, update references to park facilities to match current naming, update and clarify processes for "voting present" at city council and board and commission meetings, clarify provisions pertaining to the authority of the City Attorney to execute settlement agreements on behalf of the City, and revise bicycle and parking regulations to match recent construction. Amend Various Sections of Chapter 2, Chapter 6, Chapter 7, Chapter 8, Chapter 16, Chapter 17, Chapter 19, Chapter 20, and Chapter 27A. BACKGROUND Staff has recently reviewed the Municipal Code for general clean up, including removal or amendment of ordinances that reference outdated/incorrect code sections, departments that no longer exist, state statute cites that need to be updated, etc. ANALYSIS Below is a summary of the revisions that are proposed and the sections to be updated: - Health Department: Ordinances were revised to remove reference to the City of Oshkosh Health Department, which was removed from the City in 2012. The health department is now run by Winnebago County. o Ordinances Affected: Sections 6-17, 8-79, 16-12.1, 16-17, 16-33 - Zoning Ordinance: In December 2016, the City adopted a new Ch. 30 zoning ordinance. This adoption was a wholesale revision and as a result, multiple ordinances previously contained in Ch. 30 were renumbered. Multiple ordinances in our current Code still reference the old Ch. 30 sections. The ordinances have now been amended to cross- reference the correct sections of the new Ch. 30 and have been further amended with any other necessary changes in light of the new zoning code. All of these updates are non- substantive changes in nature and not intended to change existing requirements or interpretations. o Ordinances Affected. Sections 7-32, 7-33, 16-10, 16-15, 16-17, 16-22, 16-25, 16-51, 17-2, 20-8 City Hall,215 Church Avenue P.O Box 1130 Oshkosh,WI 54903-1130 920.236.5000 http://www.ci.oshkosh.wi.us - Lakeshore Golf Course: Ordinances were revised to remove references to Lakeshore Golf Course, or amend to refer to Lakeshore Park, as appropriate. o Ordinances Affected: Sections 2-32, 2-51, 8-43, 17-3, 19-7.1 - Little Oshkosh: The ordinance was revised to remove reference to Little Oshkosh. o Ordinance Affected: Section 19-4(J) - Council Rules of Procedure: Ordinances were revised to amend and clarify the procedure in the event a council member declines to vote for the purpose of conforming to long standing practice which does not count the vote as either yea or nay and for which an explanation has not been required but left to individual member discretion. Upon passage of this ordinance, Council and Board & Commission Rules will be updated to reflect this change. o Ordinances Affected. Sections 2-16, 2-36 - City Attorney. Ordinances were revised to reference the Deputy City Attorney position that was created in 2017. In addition the ordinance was updated to expressly codify that the City Attorney is authorized to execute settlement agreements that do not require the expenditure of City funds, something that the City Attorney has historically done. o Ordinance Affected. Section 2-24 - Bicycle Lane: In 2016 a bicycle lane on North Main Street was installed from New York to Murdock Avenue. The ordinance was revised to reference this addition. o Ordinance Affected: Section 27A-10.1 - Parking Regulations: In 2018 Court Street was reconstructed. The ordinance has been revised to reflect the parking regulations after the reconstruction. o Ordinance Affected. Box 1130 Oshkosh,WI 54903-1130 920.236.5000 http://www.ci.oshkosh.wi.us SECTION 2-16 RULES OF ORDER AND PROCEDURE (E) Voting Procedures An aye and no vote shall be called with the Mayor of the Council being called last, and recorded on the vote of every ordinance,resolution and expenditure of money and shall be taken upon any other matter requested by a Council Member. In the event that a Council Member declines to vote, the Clerk shall record the vote as "present". A majority vote of all members of the Council shall be necessary to adopt any ordinance or resolution, except where a greater number is required by law. [Statutory Reference§64.07(3)Wis. Stats.] SECTION 2-24 CITY ATTORNEY The City Attorney shall perform the duties as are prescribed in the Wisconsin Statutes, particularly Section 62.09(12) thereof, and such other duties as the City Manager may prescribe. In the absence or disability of the City Attorney, or in the case of a vacancy in the office of the City Attorney, the Deputy City Attorney shall perform the duties of City Attorney. The City Attorney is authorized to bring appropriate actions against any persons, firms or corporations in the following cases without specific or further authorization to do so: 1) To pursue collection of delinquent taxes, accounts or other indebtedness due and owing the City. 2) To cause warrants to be issued and served in ordinance violation cases. 3) To cause summonses to be issued for collection of forfeitures or fines in ordinance violation cases. 4) To commence civil actions seeking compliance with ordinance requirements or restraining actions not in compliance with ordinance requirements. The City Attorney is authorized to take all necessary and appropriate actions with regard to the defense of claims and other matters against the City, including coordination with insurance defense counsel as required and the execution of settlement agreement that do not require the expenditure City funds, without specific or further authorization to do so. The City Attorney, in his/her discretion, is authorized upon a request from another unit of government to render aid, assistance and advice to that unit of government provided doing so will not conflict with the City Attorney's duties and responsibilities to the City of Oshkosh. [Statutory Reference §§ 62.09(12)Wis. Stats.] SECTION 2-32 DEPARTMENT OF PARKS (A) The Director of Parks The Director of Parks shall supervise the operations and functions of the department of Parks and such other duties as directed by the City Manager. The Director of Parks shall be responsible to the City Manager. The Director of Parks shall be the head of any division of the Department of Parks when a vacancy exists. The Assistant Director of Parks shall be Acting Director of Parks while the Director of Parks is absent from the City or incapacitated or a temporary vacancy exists in the position of Director of Parks. The Director of Parks shall perform the following duties and such other duties as may be prescribed by the City Manager: (1) Shall provide for the operation and maintenance of all parks, playgrounds, and any other recreational facilities owned or acquired by the City; (2) Shall provide for the operation and maintenance of Pollock Water Park and Leach Amphitheatre; (3) Oversee the operation of the Forestry Division and Senior Services Division; and (4) Operate and maintain municipal cemeteries. SECTION 2-36 RULES, MINUTES, NOTICE AND COMPENSATION (J) A majority of the membership shall constitute a quorum. A lesser number may adjourn. A majority vote of those members present and voting shall be necessary to adopt any motion. In the event that a board or commission member declines to vote, except as provided below, the secretary shall record the vote as "present" and that member shall not be counted toward the number present and shall not have their vote counted as either "aye" or "no" in relation to the matter. In the event that a board or commission member declines to vote and by declining to vote,the board or commission member's declining to vote shall reduce the number present at the meeting to below a quorum of the board or commission, city staff shall consider the wishes of the applicant, any statutory or ordinance time limits and any other considerations or limitations with respect to the particular matter in determining whether to reschedule the matter before the board or commission for further consideration, forward the matter to Council or take other action as may be appropriate with regard to the matter. SECTION 2-51 ADVISORY PARK BOARD (B) Functions The Advisory Park Board is empowered and directed to: (1) Advise and assist the City Parks Director, City Administration, Common Council, and Planning Commission in planning and developing the Oshkosh Park System to include parks,open spaces, forestry, municipal cemeteries, waterways, and other related areas. SECTION 6-17 ANIMAL RUNNING AT LARGE PROHIBITED No person shall permit any animal to run at large in the City at any time. Each owner of any such animal is required to confine it within the limits of his or her premises except when it is attended to by some person, and in such cases animals shall be fastened securely to a suitable leash not more than six (6)feet in length. For purposes of this section, the phrase"running at large" embraces all places within the City except the owner's premises, and includes all streets, alleys, sidewalks, or other public or private property. (A) Unrestrained animals, including dogs and cats, may be taken by a law enforcement officer, community service officer,or personnel from the Oshkosh Animal Shelter and impounded in the Oshkosh animal shelter and there confined in a humane manner. SECTION 7-32 CERTIFICATE OF OCCUPANCY TO BE ISSUED (A) Any building, addition, or alteration in which the City of Oshkosh Inspection Services Division determines an Occupancy Inspection is required shall not be occupied or utilized until a Final Inspection by all applicable inspectors reveal that no violations of applicable codes exist that could reasonably be expected to affect the health and safety of the occupants and compliance with Section 7-31 has been provided for any other noted violations. When this determination is made, the Inspection Division shall issue an Occupancy Permit. The correction of any outstanding violations shall be made a condition of Occupancy Approval. Issuance of the Occupancy Permit shall not prevent or hinder the Inspection Division from securing compliance with such violations. The Certificate of Occupancy shall include: (1) A statement of the purpose for which the building is to be used. (2) Any conditions of approval or use. (3) The maximum number of persons who may occupy the structure, addition or area of alteration. (4) The building or premise or part thereof and the proposed use thereof are in conformity with the provisions of Chapter 30 of the municipal code. SECTION 7-33 APPEALS FROM RULINGS OF BUILDING INSPECTOR Any person feeling aggrieved by any order or ruling of the Building Inspector may appeal from such order or ruling to the Board of Zoning Appeals as provided in Chapter 30 of this code. An order or ruling written for one (1) and two (2) family homes built on or after June 1, 1980 is not appealable under this ordinance. An order or ruling written under SPS 350-364 is not appealable under this ordinance. SECTION 8-43 REGULATION OF MOBILE VENDORS IV. Mobile Vending Operations are prohibited from the following locations: k. In Residential Districts, except for the following two situations: L Mobile Vendor Operations adjacent to eligible City parks utilizing legal parking spaces or appropriate hardscape terraces upon the approval of the City Manager, or designee. Eligible City parks are defined as all City parks except Lakeshore Park, Menominee Park, Spanbauer Fields, Red Arrow Park, Pollock Community Water Park, Riverside Park, and Leach Amphitheater. SECTION 8-79 INSPECTION AND INVESTIGATION. (B) The Chief of the Fire Department shall cause to be investigated each and every junk yard at least once each year. DIVISION 3. MOBILE HOMES AND MOBILE HOME PARKS SECTION 16-10 DEFINITIONS (A) "Accessory Structure" See Section 30-22(A)(4) (B) "Common Area" means any area or space designed for joint use of tenants occupying the mobile home park. (C) REPEALED (D) 'Driveway" means a minor private way used by vehicles and pedestrians on a mobile home lot or used for common access to a small group of lots or facilities. (E) "License"means a written license issued by the City allowing a person to operate and maintain a mobile home park under the provisions of this Division and regulations issued hereunder. (F) REPEALED (G) "Mobile Home" See Section 30-22(A)(116) (H) "Mobile Home Lot"means a parcel of land located in a Mobile Home Park for the placement of a single mobile home and the exclusive use of its occupants. (I) "Mobile Home Park" means a parcel of land which has been developed for the placement of mobile homes and is owned by an individual, a firm, trust, partnership, public or private association,or corporation. (J) REPEALED (K) REPEALED (L) 'Park Management" means the person who owns or has charge, care or control of the mobile home park. (M) "Interior Street" means a private way which affords principal means of access to individual mobile home lots or auxiliary buildings. (N) 'Permit" means a written permit or certification issued by the City permitting the construction, alteration and extension of a mobile home park under the provisions of this division and regulations issued hereunder. (0) 'Person" means any individual, firm, trust, partnership, public or private association or corporation. (P) REPEALED SECTION 16-12.1 REPEALED SECTION 16-15 GENERAL REQUIREMENTS (A) Any person making application for a permit to construct a mobile home park shall meet the following design and system requirements: (1) Environmental Requirements: (d) Setback and buffer strip: Each mobile home shall be located at least five (5) feet from any mobile home lot line. There shall be a minimum distance of twenty (20) feet between the mobile home stand and the back of curb of the abutting internal street. All mobile homes shall be located at least twenty-five (25) feet from any park property boundary line including public streets. No mobile home shall be located closer than forty (40) feet from any community building,including any washroom, toilet,or laundry facilities within the park. (g) Allowable uses: Mobile homes as defined in this Division shall be allowed, and any approved accessory structures included in the original plans and specifications, or revisions thereof. Mobile homes that do not have complete bathroom facilities shall specifically be prohibited from placement within mobile home parks. Parks, playgrounds and open-space shall be allowed, as well as the following commercial uses when they are for the exclusive use of park residents: (1) Mobile home park office. (ii) Laundromat. (iii) Clubhouse and facilities for private social or recreation clubs. (iv) Storage building. Signs pertaining to the lease, hire or sale of individual mobile homes, not more than two (2) square feet in area shall be allowed, as well as one (1) mobile home park identification sign not more than fifty(50) square feet in area, to be located in proximity to the park entrance. (2) Access Requirements. (c) Internal Streets: Surfaced roadways shall be of adequate width to accommodate anticipated traffic and in any case shall meet the following minimum requirements. (i) All two-way internal streets shall be 24' in width and all one-way internal streets shall be 14'in width. Dead end streets (cul-de-sacs) shall be limited in length to 1,000 feet and shall be provided at the closed end with a turnaround having an outside roadway diameter of at least sixty (60)feet. (ii) Pavements: All internal streets shall be provided with a minimum of 9" crushed stone base covered with a 3" asphalt surface. Concrete curb and gutter shall be required on all streets. (d) REPEALED (f) Walkways: All parks shall be provided with safe, convenient, all-season pedestrian access of adequate width for intended use, durable and convenient to maintain, between individual mobile homes, the internal streets and all community facilities provided for park residents. (1) Common Walk System: A common walk system shall be provided and maintained between locations where pedestrian traffic is concentrated. Such common walks shall have a minimum width of three and one-half(3 1/2)feet. (ii) Individual Walks: All mobile home stands shall be connected to common walks,to paved streets,or to paved driveways or parking spaces connected to a paved street or roadway. Such individual walks shall have a minimum width of two(2)feet. (3) Mobile Home Installation Standards. All mobile homes shall be installed pursuant to the standards set forth in Wis. Admin. Code. SPS 321.40. SECTION 16-17 LOCATION OF MOBILE HOMES (A) Mobile homes intended for purposes of human habitation are prohibited within the corporate limits of the City, except as licensed for mobile home park use in compliance with this Division or except as provided in Subsection(b). (B) The Department of Community Development is authorized to issue temporary permits for the parking of trailers to be used as field offices during the construction of a building project on the construction site pursuant to Section 30-87. SECTION 16-22 DEFINITIONS (A) The following definitions shall apply in the interpretation and enforcement of the Minimum Housing Code: (1) APARTMENT HOTEL. Same as "Hotel". (2) APPROVED. "Approved" shall mean in accordance with regulation established by City ordinance or Code and authority designated by law to enforce such ordinance or Code. (3) BASEMENT. See Section 30-22(A)(22). (4) BATH. 'Bath"shall mean a bathtub or shower stall properly connected with both hot and cold water lines. (5) BATHROOM. 'Bathroom" shall mean a non-habitable room with a dwelling unit which is used, or intended to be used, primarily for bathing and/or toilet purposes, and which contains a toilet, lavatory,bathtub or shower facilities. (6) BEDROOM. 'Bedroom" shall mean a habitable room within a dwelling unit which is used, or intended to be used, primarily for the purpose of sleeping, but shall not include any kitchen or dining room. Bedroom,however, shall not be interpreted so as to prohibit efficiency apartments. (7) CITY. "City" shall mean the City of Oshkosh,Wisconsin. (8) COMMUNAL. "Communal" shall mean used or shared by, or intended to be used or shared by,the occupants of two or more rooming units or two or more dwelling units. (9) DEADBOLT LOCKING DEVICE. "Deadbolt Locking Device" shall mean any keyed, mortised lockset with at least a 3/4 inch bolt capable of being opened from the inside by a single turn of a knob. (10) DWELLING. See Section 30-22(A)(54). (a) DWELLING, SINGLE FAMILY. See Section 30-75(A). (b) DWELLING, TWO-FAMILY. See Section 30-75(B), (C) and (D). (c) DWELLING,MULTIPLE OR APARTMENT BUILDING. See Section 30-75(F)and (G). (d) MOBILE HOME. See Section 16-10(G). (11) DWELLING UNIT. See Section 30-22(A)(57). (12) EFFICIENCY APARTMENT. "Efficiency Apartment" shall be a dwelling unit consisting of one habitable room. (13) EXTERMINATION. "Extermination" shall mean the control and elimination of insects, rodents or other pests by elimination of their harborage places, by removing or making inaccessible material that may serve as their food,by poisoning, spraying, trapping or by any other recognized and legal elimination method. (14) FAMILY. See Section 30-22(A)(62). (15) GARBAGE. "Garbage" shall mean the animal and vegetable waste resulting from the preparation, handling, cooking and consumption of food. (16) HABITABLE ROOM. "Habitable Room" shall mean a room or enclosed floor space used or intended to be used for living, sleeping, cooking or eating purposes, excluding bathrooms, laundries, pantries, foyers, communicating corridors, closets and storage spaces. (17) HOTEL. See Section 30-78(0). SECTION 16-25 APPEALS FROM ORDERS OF HOUSING INSPECTOR Any person feeling aggrieved by any order or ruling of the Housing Inspector may appeal from such order or ruling to the Board of Zoning Appeals as provided for in Chapter 30 of this code. An order or ruling written under the State Building Code is not appealable under this ordinance. SECTION 16-33 MINIMUM STANDARDS FOR EQUIPMENT AND FACILITIES (A) All habitable buildings subject to the provisions of this Article shall comply with the following requirements for basic equipment and facilities. (5) Garbage and refuse receptacles. Every owner shall supply every dwelling unit with adequate garbage and refuse disposal equipment or receptacles large enough to hold all garbage and refuse generated by that dwelling unit. Such receptacles shall comply with the requirements and standards set by the Department of Public Works and shall be maintained by the owner or occupant in serviceable condition. SECTION 16-51 DEFINITIONS (A) The following definitions shall apply in the interpretation and enforcement of the Residential Rental Contact and Inspection Code: (1) CHIEF BUILDING OFFICIAL. "Chief Building Official" shall include the designee of the Chief Building Official. (2) CITY. "City" shall mean the City of Oshkosh,Wisconsin. (3) DEPARTMENT. "Department" shall mean the City of Oshkosh Division of Inspection Services of the Department of Community Development. (4) DWELLING UNIT: A room or group of rooms providing or intended to provide permanent living quarters for not more than one family. (5) FAMILY. See Section 30-22(A)(62). SECTION 17-2 REGULATION OF ADULT ENTERTAINMENT FACILITIES (B) No person, partnership, corporation or other entity shall own, operate, manage, rent, lease, occupy, or exercise control of any building, structure, premises, or portion or part thereof, (a) within which occurs the activities specified in this Section if otherwise allowed or (b) housing a special cabaret, as of the effective date of this ordinance that is located closer than 500 feet from the nearest lot line, that is the legal boundaries of a parcel of property,of a similar establishment, or,if so licensed,of another Class'B"/"Class B"establishment,or any facility governed by Section 15-19 of this municipal code, or any school (whether pre-school, elementary, middle or high school, whether public or private),or any residentially zoned property,library, church or chapel, park or playground, or licensed day-care facility. (1) It is the intent of this subparagraph that such establishments, whose operations on the effective date of this Ordinance would otherwise subject them to regulation of this subsection, shall be subject to the nonconforming use regulations found in Chapter Section 30 of this Code, except that such privilege of nonconforming use shall cease upon the discontinuance of the specified activities within such establishment for seven consecutive calendar days, including any days when the establishment is normally closed for business. (a) All buildings regulated by the City's Subdivision Ordinance shall be provided with a foundation drain tile sump pump system that connects to the public storm sewer system or discharges to other acceptable points as required by the City's Subdivision Ordinance, Section 30-445(C)(5). (b) All new buildings with a storm drain foundation system shall be connected to the public storm sewer system in compliance with all applicable chapters or discharge to other acceptable points as required by the City's Subdivision Ordinance,Section 30-445(C)(5). If the public storm drainage system is not available to the property at the time of construction then the property owner will be required to apply for the installation of and connect to the public storm drainage system within 12 months after installation of the public storm drainage system. (c) All existing buildings with a foundation drain system in operation on April 1,2017 shall be permitted to stay in operation as long as it does not create a nuisance to the public and are not connected to the sanitary sewer system. If a building in existence on April 1, 2017 does not have a foundation drain system and a foundation drain system is installed on the property, the system may be connected, but shall not be required to connect, to the public storm drainage system. The foundation drain system shall be installed in compliance with all applicable codes so as to not create a nuisance to the public. SECTION A-10.1 BICYCLE LANES DESIGNATED The following designated bicycle lanes shall be in effect year-round: Algoma Boulevard,northerly side, from Jackson Street to Woodland Avenue. Elmwood Avenue,both sides, from Irving Avenue to Vine Avenue. High Avenue, southerly side, from Congress Avenue to Jackson Street. Irving Avenue,both sides, from Wisconsin Street to Hazel Street. North Koeller Street,both sides from North Westfield Street to Rath Lane. North Main Street,both sides, from Irving Avenue to Snell Road. North Westfield Street,both sides from 137' from North of Oshkosh Avenue to North Koeller Street. Oakwood Road,both sides,between 9th Avenue and 20th Avenue. Osborn Avenue,both sides,from Knapp Street to Koeller Street. Sawyer Street,from 5t',Avenue to Fillmore Avenue easterly side, to Buchanan Avenue westerly side. Smith Avenue,both sides,from Vinland Street to Jackson Street. Snell Road,both sides, from Jackson Street to Moser Street Taft Avenue,both sides, from north Koeller Street to north Sawyer Street. SECTION 2-16 RULES OF ORDER AND PROCEDURE (E)Voting Procedures An aye and no vote shall be called with the Mayor of the Council being called last,and recorded on the vote of every ordinance,resolution and expenditure of money and shall be taken upon any other matter requested by a Council Member. [Statutory Reference §64.07(3)Wis.Stats.] SECTION 2-24 CITY ATTORNEY The City Attorney shall perform the duties as are prescribed in the Wisconsin Statutes, particularly Section 62.09(12) thereof, and such other duties as the City Manager may prescribe. In the absence or disability of the City Attorney, or in the case of a vacancy in the office of the City Attorney,the ^ssist A De u City Attorney shall perform the duties of City Attorney. The City Attorney is authorized to bring appropriate actions against any persons, firms or corporations in the following cases without specific or further authorization to do so: 1) To pursue collection of delinquent taxes,accounts or other indebtedness due and owing the City. 2) To cause warrants to be issued and served in ordinance violation cases. 3) To cause summonses to be issued for collection of forfeitures or fines in ordinance violation cases. 4) To commence civil actions seeking compliance with ordinance requirements or restraining actions not in compliance with ordinance requirements. The City Attorney is authorized to take all necessary and appropriate actions with regard to the defense of claims and other matters against the City, including coordination with insurance defense counsel as required and the execution of settlement agreement that do not require the expenditure City funds,without specific or further authorization to do so. The City Attorney, in his/her discretion, is authorized upon a request from another unit of government to render aid,assistance and advice to that unit of government provided doing so will not conflict with the City Attorney's duties and responsibilities to the City of Oshkosh. [Statutory Reference§§62.09(12)Wis.Stats.] SECTION 2-32 DEPARTMENT OF PARKS (A) The Director of Parks The Director of Parks shall supervise the operations and functions of the department of Parks and such other duties as directed by the City Manager. The Director of Parks shall be responsible to the City Manager. The Director of Parks shall be the head of any division of the Department of Parks when a vacancy exists. The Assistant Director of Parks shall be Acting Director of Parks while the Director of Parks is absent from the City or incapacitated or a temporary vacancy exists in the position of Director of Parks. The Director of Parks shall perform the following duties and such other duties as may be prescribed by the City Manager: (1) Shall provide for the operation and maintenance of all parks,playgrounds,and any other recreational facilities owned or acquired by the City; (2) Shall provide for the operation and maintenance of the r4.1 jeipa Golf r-,.....,., Pollock Water Park and Leach Amphitheatre; (3) Oversee the operation of the Forestry Division and Senior Services Division;and (4) Operate and maintain municipal cemeteries. SECTION 2-36 RULES,MINUTES,NOTICE AND COMPENSATION (J) A majority of the membership shall constitute a quorum. A lesser number may adjourn. A majority vote of those members present and voting shall be necessary to adopt any motion. In the event that a board or commission member declines to vote,except as provided below, the secretary shall record the vote as"present' and that member shall not be counted toward the number present and shall not have their vote counted as either"aye"or"no"in relation to the matter. In the event that a board or commission member declines to vote and by declining to vote,the board or commission member's declining to vote shall reduce the number present at the meeting to below a quorum of the board or commission,city staff shall consider the wishes of the applicant,any statutory or ordinance time limits and any other considerations or limitations with respect to the particular matter in determining whether to reschedule the matter before the board or commission for further consideration,forward the matter to Council or take other action as may be appropriate with regard to the matter. SECTION 2-51 ADVISORY PARK BOARD (B) Functions The Advisory Park Board is empowered and directed to: (1) Advise and assist the City Parks Director, City Administration, Common Council, and Planning Commission in planning and developing the Oshkosh Park System to include parks, open spaces, forestry,;oog-ee...ses,municipal cemeteries, waterways, and other related areas. SECTION 6-17 ANIMAL RUNNING AT LARGE PROHIBITED No person shall permit any animal to run at large in the City at any time. Each owner of any such animal is required to confine it within the limits of his or her premises except when it is attended to by some person,and in such cases animals shall be fastened securely to a suitable leash not more than six(6)feet in length.For purposes of this section,the phrase"running at large"embraces all places within the City except the owner's premises, and includes all streets, alleys, sidewalks, or other public or private property. (A) Unrestrained animals, including dogs and cats, may be taken by a law enforcement officer, community service officer, or personnel from the Oshkosh Animal Shelter, ^r r. 14ealth PiN4sion personf-4 and impounded in the Oshkosh animal shelter and there confined in a humane manner. SECTION 7-32 CERTIFICATE OF OCCUPANCY TO BE ISSUED (A) Any building,addition,or alteration in which the City of Oshkosh Inspection Services Division determines an Occupancy Inspection is required shall not be occupied or utilized until a Final Inspection by all applicable inspectors reveal that no violations of applicable codes exist that could reasonably be expected to affect the health and safety of the occupants and compliance with Section 7-31 has been provided for any other noted violations. When this determination is made, the Inspection Division shall issue an Occupancy Permit. The correction of any outstanding violations shall be made a condition of Occupancy Approval. Issuance of the Occupancy Permit shall not prevent or hinder the Inspection Division from securing compliance with such violations.The Certificate of Occupancy shall include: (1) A statement of the purpose for which the building is to be used. (2) Any conditions of approval or use. (3) The maximum number of persons who may occupy the structure, addition or area of alteration. (4) The building or premise or part thereof and the proposed use thereof are in conformity with the provisions of Chapter 30 of the municipal code SECTION 7-33 APPEALS FROM RULINGS OF BUILDING INSPECTOR Any person feeling aggrieved by any order or ruling of the Building Inspector may appeal from such order or ruling to the Board of Zoning Appeals as provided in Seetie4;Chapter 30-6(9}of this code. An order or ruling written for one(1)and two(2)family homes built on or after June 1,1980 is not appealable under this ordinance. An order or ruling written under SPS 350-364 is not appealable under this ordinance. SECTION 8-43 REGULATION OF MOBILE VENDORS IV. Mobile Vending Operations are prohibited from the following locations: k. In Residential Districts,except for the following two situations: i. Mobile Vendor Operations adjacent to eligible City parks utilizing legal parking spaces or appropriate hardscape terraces upon the approval of the City Manager, or designee. Eligible City parks are defined as all City parks except Lakeshore Mtmieipal Park, Menominenee Park, Spanbauer Fields, Red Arrow Park,Pollock Community Water Park,Riverside Park,and Leach Amphitheater. SECTION 8-79 INSPECTION AND INVESTIGATION. (B) The Chief of the Fire Department shall cause to be investigated each and every junk yard at least once each year. DIVISION 3. There shall be a minimum distance of twenty(20)feet between the mobile home stand and the back of curb of the abutting internal street. All mobile homes shall be located at least twenty-five (25) feet from any park property boundary line including public streets. No mobile home shall be located closer than forty(40)feet from any community building,including any washroom,toilet,or laundry facilities within the park. (g) Allowable uses: Mobile homes as defined in this Division shall be allowed, and any approved accessory structures included in the original plans and specifications, or revisions thereof. Signs pertaining to the lease,hire or sale of individual mobile homes,not more than two(2)square feet in area shall be allowed,as well as one(1)mobile home park identification sign not more than fifty(50)square feet in area,to be located in proximity to the park entrance. (2) Access Requirements. (c) Internal Streets: Surfaced roadways shall be of adequate width to accommodate anticipated traffic and in any case shall meet the following minimum requirements. Same as"Hotel'. (2) APPROVED. "Approved"shall mean in accordance with regulation established by City ordinance or Code and authority designated by law to enforce such ordinance or Code. (3) BASEMENT. See Section 30422(Al(22). (4) BATH. 'Bath"shall mean a bathtub or shower stall properly connected with both hot and cold water lines. (5) BATHROOM. 'Bathroom"shall mean a non-habitable room with a dwelling unit which is used,or intended to be used,primarily for bathing and/or toilet purposes,and which contains a toilet,lavatory,bathtub or shower facilities. (6) BEDROOM. 'Bedroom" shall mean a habitable room within a dwelling unit which is used,or intended to be used,primarily for the purpose of sleeping,but shall not include any kitchen or dining room. Bedroom,however,shall not be interpreted so as to prohibit efficiency apartments. (7) CITY. "City"shall mean the City of Oshkosh,Wisconsin. (8) COMMUNAL. "Communal' shall mean used or shared by, or intended to be used or shared by,the occupants of two or more rooming units or two or more dwelling units. (9) DEADBOLT LOCKING DEVICE. "Deadbolt Locking Device" shall mean any keyed, mortised lockset with at least a 3/4 inch bolt capable of being opened from the inside by a single turn of a knob. (10) DWELLING. See Section 30-22(A)(62)47. (15) GARBAGE. "Garbage" shall mean the animal and vegetable waste resulting from the preparation,handling,cooking and consumption of food. (16) HABITABLE ROOM. "Habitable Room"shall mean a room or enclosed floor space used or intended to be used for living, sleeping, cooking or eating purposes, excluding bathrooms, laundries, pantries, foyers, communicating corridors, closets and storage spaces. (17) HOTEL. See Section 30-78(O147. SECTION 16-25 APPEALS FROM ORDERS OF HOUSING INSPECTOR Any person feeling aggrieved by any order or ruling of the Housing Inspector may appeal from such order or ruling to the Board of Zoning Appeals as provided for in-� Chapter 30-6�B4 of this code. An order or ruling written under the State Building Code is not appealable under this ordinance. SECTION 16-33 MINIMUM STANDARDS FOR EQUIPMENT AND FACILITIES (A) All habitable buildings subject to the provisions of this Article shall comply with the following requirements for basic equipment and facilities. (5) Garbage and refuse receptacles. Every owner shall supply every dwelling unit with adequate garbage and refuse disposal equipment or receptacles large enough to hold all garbage and refuse generated by that dwelling unit. Such receptacles shall comply with the requirements and standards set by the Department of Public Works and flh^ D-i;4 9 ,and shall be maintained by the owner or occupant in serviceable condition. SECTION 16-51 DEFINITIONS (A) The following definitions shall apply in the interpretation and enforcement of the Residential Rental Contact and Inspection Code: (1) CHIEF BUILDING OFFICIAL. "Chief Building Official'shall include the designee of the Chief Building Official. (2) CITY. "City"shall mean the City of Oshkosh,Wisconsin- (3) DEPARTMENT. "Department' shall mean the City of Oshkosh Division of Inspection Services of the Department of Community Development. (4) DWELLING UNIT: A room or group of rooms providing or intended to provide permanent living quarters for not more than one family. (5) FAMILY. See Section 30-22(A)(62)1. SECTION 17-2 REGULATION OF ADULT ENTERTAINMENT FACILITIES (B) No person, partnership, corporation or other entity shall own, operate, manage, rent, lease, occupy, or exercise control of any building, structure,premises, or portion or part thereof, (a) within which occurs the activities specified in this Section if otherwise allowed or(b)housing a special cabaret,as of the effective date of this ordinance that is located closer than 500 feet from the nearest lot line,that is the legal boundaries of a parcel of property,of a similar establishment, or,if so licensed,of another Class'B"/"Class B"establishment,or any facility governed by Section 15-19 of this municipal code, or any school (whether pre-school, elementary, middle or high school,whether public or private),or any residentially zoned property,library,church or chapel, park or playground,or licensed day-care facility. (1) It is the intent of this subparagraph that such establishments, whose operations on the effective date of this Ordinance would otherwise subject them to regulation of this subsection, shall be subject to the previsien&-efnonconforming use regulations found in Chapter Section 30,+NON CONF-C*MING r rcE REGU n'r 0NS of this Code,except that such privilege of nonconforming use shall cease upon the discontinuance of the specified activities within such establishment for seven consecutive calendar days, including any days when the establishment is normally closed for business. (a) All buildings regulated by the City's Subdivision Ordinance shall be provided with a foundation drain tile sump pump system that connects to the public storm sewer system or discharges to other acceptable points as required by the City's Subdivision Ordinance,Section 30-44574(C)(5). (b) All new buildings with a storm drain foundation system shall be connected to the public storm sewer system in compliance with all applicable chapters or discharge to other acceptable points as required by the City's Subdivision Ordinance,Section 3044574(C)(5). If the public storm drainage system is not available to the property at the time of construction then the property owner will be required to apply for the installation of and connect to the public storm drainage system within 12 months after installation of the public storm drainage system. (c) All existing buildings with a foundation drain system in operation on April 1,2017 shall be permitted to stay in operation as long as it does not create a nuisance to the public and are not connected to the sanitary sewer system. If a building in existence on April 1, 2017 does not have a foundation drain system and a foundation drain system is installed on the property, the system may be connected, but shall not be required to connect, to the public storm drainage system. The foundation drain system shall be installed in compliance with all applicable codes so as to not create a nuisance to the public.
