That Sections 27-57, 27-58, 27-61, and 27-62 of the Oshkosh Municipal Code are hereby amended to read as shown on the attachment to this ordinance. SECTION 2. That Sections 27-59 and 27-60 of the Oshkosh Municipal Code are hereby repealed. SECTION 3. This ordinance shall be in full force and effect from and after its passage, and publication. SECTION 4. Publication Notice Please take notice that the City of Oshkosh enacted ordinance #20-318 AMEND BICYCLE REGISTRATION ORDINANCES (A GENERAL ORDINANCE OF THE CITY OF OSHKOSH AMENDING SECTION 27-57, 27-58, 27-61 AND 27-62 AND REPEALING 27- 59 AND 27-60 OF THE OSHKOSH MUNICIPAL CODE PERTAINING TO BICYCLE REGISTRATION) on July 14, 2020. The amended ordinance eliminates the bicycle registration fee, eliminates the physical bicycle license, and moves the bicycle registration online through the City website. June 18, 2020 RE: Amend Bicycle Registration Ordinances BACKGROUND In 1979, the City implemented a bicycle registration and licensing program. One of the primary benefits of bicycle registration is that it assists the Oshkosh Police Department in returning stolen bicycles to their owners. The current fee to register a bicycle in the City is $3.00. Unfortunately, participation in the bicycle registration program has been steadily decreasing. See below for the number of paid licenses issued for the past five years: • 2016 - 143 licenses • 2017— 109 licenses • 2018 —47 licenses • 2019 —36 licenses • 2020—3 licenses For a two month period in 2013 and 2014, the City waived the registration fee and offered free registration. During that period in 2013, the City issued 1,013 free licenses—more licenses than had otherwise been issued in the last 9 years of the program's existence. Many of these free licenses were issued in connection with bicycle rodeos and other special efforts to push bicycle registration. In 2015, the Council amended the bicycle registration ordinance to annually waive bicycle fees for the months of April and May. Despite these efforts, bicycle registration overall has continued to decline. ANALYSIS With decreased participation in bicycle registration, fewer stolen bikes are able to be returned to their owners. In order to encourage increased participation in the bicycle registration program, staff is proposing two primary changes: City Hall,215 Church Avenue P.O Box 1130 Oshkosh,WI 54903-1130 920.236.5000 http://www ci.oshkosh.wi.us 1. Removal of Bicycle Registration Fee and Licenses: Because even a nominal fee may be an obstacle to registration, staff is proposing to permanently eliminate the registration fee. With the removal of the fee, the City will no longer provide actual licenses/stickers for the bicycle. However, the bicycles will still be registered by the bicycle's unique serial number found on the frame. As a result, the elimination of the license should not impact the program or the Police Department's ability to identify bicycles. 2. Online Bicycle Registration: Another current impediment to bicycle registration may be the process, which absent a bike rodeo or other special initiative requires the applicant to come to City Hall to complete a registration. For purposes of increasing participation, staff is proposing that bicycle registration be completed online at the City website. Not only will online registration provide art easier and more accessible registration for most families, it also will be more efficient for staff. For those individuals who do not have access to the internet, a self-service kiosk will be available on the 1st Floor of City Hall for this purpose. Filed along with this memo is a copy of the red-lined version of all proposed changes. As a general summary, Section 27-59 has been repealed to eliminate the $3.00 registration fee. Sections 27-57, 27-58, and 27-61 have been amended and Section 27-60 has been repealed to reflect the elimination of physical bicycle licenses/stickers. Sections 27-58 and 27-62 have been amended to reflect the new online registration process. FISCAL IMPACT The proposed ordinance eliminates the bicycle registration fee, so there will be a nominal fiscal impact. However,the$3.00 registration fee covered the cost of the bicycle license/sticker (which has also been eliminated under the proposed ordinance), further offsetting any fiscal impact. BICYCLE AND IN-LINE SKATES REGULATIONS SECTION 27-57 BICYCLE REGISTRATION REQUIRED No person who resides within the City limits shall operate a bicycle upon any street,bicycle way, public right-of-way or sidewalk within the City without having first registered the bicycle as provided in this Article. No parent or guardian of any child shall authorize, allow or knowingly permit such child to operate a bicycle within the City unless said bicycle is first registered as provided in this Article. SECTION 27-58 BICYCLE REGISTRATION PROCEDURE Bicycles shall be registered within 30 days after either: 1) the date the bicycle is purchased; or 2) the date the bicycle is brought into the City. Said registration shall be permanent, lasting the lifetime of the bicycle or until ownership is transferred. Registration shall be made by filing an application setting forth the name, address, and contact information of the owner, together with a complete description of the bicycle and its serial number. Registrations can be completed online through the City website, or made in person at City Hall. There shall be no fee for the bicycle registration. SECTION 27-59 REPEALED SECTION 27-60 REPEALED SECTION 27-61 MUTILATION OF SERIAL NUMBER It shall be unlawful for any person to willfully or maliciously remove, destroy, mutilate or alter the serial number of any bicycle frame registered pursuant to this ordinance. SECTION 27-62 TRANSFER OR CANCELLATION Within ten (10) days after any bicycle registered hereunder shall have changed ownership or be dismantled and taken out of use, the person in whose name the bicycle has been registered shall report such information to City. Said report can be made online though the City website, or can be done in person at City Hall. ARTICLE VIII.
