HomeMy WebLinkAbout08. 20-306 JULY 14, 2020 20-306 RESOLUTION (CARRIED 7-0 LOST LAID OVER WITHDRAWN ) PURPOSE: APPROVE INITIAL RESOLUTION FOR SPECIAL ASSESSMENTS FOR STORM SEWER LATERALS RELATING TO CONTRACT NO. 20-15 /VARIOUS LOCATIONS INITIATED BY: DEPARTMENT OF PUBLIC WORKS BE IT RESOLVED BY the Common Council of the City of Oshkosh as follows: 1. The Common Council hereby declares its intention to exercise its police power under Section 66.0703 and 66.0705 of the Wisconsin Statutes to levy special assessments upon property within the following described areas for benefits conferred upon such property by improving the following: Storm Sewer Laterals 1056 West 911,Avenue 1625 Spruce Street 904 Nicolet Avenue 1222 West 1111,Avenue 1812 Hollister Avenue 915 Jefferson Street 1230 Camden Lane 1605 Crestview Drive 2115 White Swan Drive 675 Boyd Street 1828 McCurdy Street 1109 Hazel Street 2490 Clover Street 1025 South Sawyer Street 1008 South Sawyer Street 1310 Western Street 1355 Morgan Avenue 1321 Punhoqua Street 1221 West 11t,Avenue 1229 West 1111,Avenue 1812 McCurdy Street 1816 McCurdy Street 1822 McCurdy Street 1000 South Sawyer Street 1002 South Sawyer Street 2. The total amount assessed against such district shall not exceed the total cost of the improvements and the amount assessed against any parcel shall not be greater than the benefits accrued thereto from said improvements. Approve Initial Resolution for Special Assessments for Storm Sewer Laterals Relating to Contract No.20-15/Various Locations BACKGROUND This resolution is the initial resolution for allowing the City to assess property owners for improvements to be completed during the construction of mini storm sewers and storm laterals. The assessable work will include the installation of storm sewer laterals and surface drains. This year, due to a favorable bid result in the earlier Storm Sewer Laterals program, we are preparing a second program to reduce the backlog of properties requesting to join this program. The following properties have requested to be included in this year's second program: 1056 West 9th Avenue 1625 Spruce Street 904 Nicolet Avenue 1222 West 11th Avenue 1812 Hollister Avenue 915 Jefferson Street 1230 Camden Lane 1605 Crestview Drive 2115 White Swan Drive 675 Boyd Street 1828 McCurdy Street 1109 Hazel Street 2490 Clover Street 1025 South Sawyer Street 1008 South Sawyer Street 1310 Western Street 1355 Morgan Avenue 1321 Punhoqua Street The following properties are included in this year's second program due to limited additional work required to provide a storm sewer lateral connection: 1221 West 11th Avenue 1229 West 11th Avenue 1812 McCurdy Street 1816 McCurdy Street 1822 McCurdy Street 1000 South Sawyer Street 1002 South Sawyer Street I\Engineering\2020 CONTRACTS\20-15 Mini Page 1 of 2 Storm\prolect_Informatron\Correspondence\Memo\20-15 Initial Resolution Merno_7-9-20 docx ANALYSIS The resolution allows City staff to proceed with preparing assessments for the abutting properties. A public hearing needs to be held and a final resolution needs to be approved by the Council prior the assessments being levied on the properties. Although Council has created a committee to review potential changes to the City's special assessment policy, we still need to follow these special assessment procedures until such time as the policy is amended. FISCAL IMPACT Assessments allow the City to recover a portion of the costs associated with projects from benefiting properties. Funding for the projects is included in the 2020 Capital Improvement Program in the Storm Sewer section. RECOMMENDATIONS I recommend approval of the initial resolution. Approved: 1- Mark A.
