PURPOSE: ACCEPT SIDEWALK EASEMENT 3701 SUMMERSET WAY
INITIATED BY: CITY OF OSHKOSH
PLAN COMMISSION RECOMMENDATION: Approved
BE IT RESOLVED by the Common Council of the City of Oshkosh that the City
hereby accepts a sidewalk easement at 3701 Summerset Way, per the attached, and the
proper City officials are authorized and directed to execute any and all documents
necessary for purposes of same.

BACKGROUND / ANALYSIS
The subject site is located at the southwest edge of the parcel along W. Snell Road. The proposed
easement is a small wedge-shaped area, 6.26' x 39.45' x 39.99' and 123.56 square feet in size,
located at the southwest corner of the property.
The City is reconstructing Snell Road and as part of that reconstruction, public sidewalks are
being installed within the public right-of-way. Based on the existing configuration of the public
right-of-way and of certain parcels along Snell Road, including 3701 Summerset Way, small
edges or corners of parcels are necessary to be used to ensure the proper layout of the new public
sidewalk. This easement satisfies that need for this parcel. The City will have continued rights
to access the easement area to maintain the facilities. The City has been working with the
property owner and the owner has agreed to grant the easement. The City Attorney's office has
drafted the necessary easement documents. The Department of Public Works does not have
concerns with the proposal and will work with the property owner to have the appropriate
easement documents signed and recorded at the Winnebago County Register of Deeds upon
Common Council approval.
RECOMMENDATION
The Plan Commission recommended approval of the acceptance of the proposed sidewalk
easement at its June 2, 2020 meeting. Please see the attached staff report and meeting minutes
for more information.

GENERAL INFORMATION
Applicant: City of Oshkosh Department of Public Works

Actions Requested:
The City of Oshkosh is requesting acceptance of an easement to allow placement of a sidewalk
in the southwest edge of 3701 Summerset Way.
Applicable Ordinance Provisions:

Property Location and Background Information:

The Plan Commission approved of the acceptance of the proposed sidewalk easement as
