JUNE 9, 2020 20-247 RESOLUTION (CARRIED 7-0 LOST LAID OVER WITHDRAWN ) PURPOSE: ACCEPT SIDEWALK EASEMENT AT 3700 JACKSON STREET INITIATED BY: CITY OF OSHKOSH PLAN COMMISSION RECOMMENDATION: Approved BE IT RESOLVED by the Common Council of the City of Oshkosh that the City hereby accepts a sidewalk easement at 3700 Jackson Street, per the attached, and the proper City officials are authorized and directed to execute any and all documents necessary for purposes of same. TO: Honorable Mayor and Members of the Common Council FROM: Mark Lyons Planning Service Manager DATE: June 4, 2020 RE: Accept Sidewalk Easement at 3700 Jackson Street (Plan Commission Recommends Approval) BACKGROUND / ANALYSIS The subject site is located at the northwest corner of Jackson Street Drive and West Snell Road. The proposed easement is a small rectangle, 6.98' x 4.55' x 6.26' x 4.53 and 29.86 square feet in size, located at the southeast corner of the property. The City is reconstructing Snell Road and as part of that reconstruction, public sidewalks are being installed within the public right-of-way. Based on the existing configuration of the public right-of-way and of certain parcels along Snell Road, including 3700 Jackson Street, small edges or corners of parcels are necessary to be used to ensure the proper layout of the new public sidewalk. This easement satisfies that need for this parcel. The City will have continued rights to access the easement area to maintain the facilities. The City has been working with the property owner and he has agreed to grant the easement. The City Attorney's office has drafted the necessary easement documents. The Department of Public Works does not have concerns with the proposal and will work with the property owner to have the appropriate easement documents signed and recorded at the Winnebago County Register of Deeds upon Common Council approval. RECOMMENDATION The Plan Commission recommended approval of the acceptance of the proposed sidewalk easement at its June 2, 2020 meeting. RECOMMENDATION/CONDITIONS Staff recommends approval of the acceptance of the proposed sidewalk easement as proposed. The Plan Commission approved of the acceptance of the proposed sidewalk easement as requested. The following is the Plan Commission's discussion on this item.
