HomeMy WebLinkAboutItem II.EPLAN COMMISSION STAFF REPORT ITEM II.E: ACCEPT SIDEWALK EASEMENT AT 3700 JACKSON STREET GENERAL INFORMATION Applicant: City of Oshkosh Department of Public Works Owner: ANJU Oil Corp Actions Requested: JUNE 2, 2020 The City of Oshkosh is requesting acceptance of an easement to allow placement of a sidewalk at the southeast corner of 3700 Jackson Street. Applicable Ordinance Provisions: N/A Property Location and Background Information: The subject site is located at the northwest corner of Jackson Street Drive and West Snell Road. The proposed easement is a small rectangle, 6.98' x 4.55' x 6.26' x 4.53 and 29.86 square feet in size, located at the southeast corner of the property. ANALYSIS The City is reconstructing Snell Avenue and as part of that reconstruction, public sidewalks are being installed within the public right-of-way. Based on the existing configuration of the public right-of-way and of certain parcels along Snell, including 3700 Jackson Street, small edges or corners of parcels are necessary to be used to ensure the proper layout of the new public sidewalk. This easement satisfies that need for this parcel. The City will have continued rights to access the easement area to maintain the facilities. The City has been working with the property owner and he has agreed to grant the easement. The City Attorney's office has drafted the necessary easement documents. The Department of Public Works does not have concerns with the proposal and will work with the property owners to have the appropriate easement documents signed and recorded at the Winnebago County Register of Deeds upon Common Council approval. RECOMMENDATION/CONDITIONS Staff recommends approval of the acceptance of the proposed sidewalk easement as proposed.
