HomeMy WebLinkAboutItem II.FPLAN COMMISSION STAFF REPORT ITEM II.F: ACCEPT SIDEWALK EASEMENT AT 3701 SUMMERSET WAY GENERAL INFORMATION Applicant: City of Oshkosh Department of Public Works Owner: Blue Moon Holdings, LLC Actions Requested: JUNE 2, 2020 The City of Oshkosh is requesting acceptance of an easement to allow placement of a sidewalk in the southwest edge of 3701 Summerset Way. Applicable Ordinance Provisions: N/A Property Location and Background Information: The subject site is located at the southwest edge of the parcel along W. Snell Road. The proposed easement is a small wedge-shaped area, 6.26' x 39.45' x 39.99' and 123.56 square feet in size, located at the southwest corner of the property. ANALYSIS The City is reconstructing Snell Avenue and as part of that reconstruction, public sidewalks are being installed within the public right-of-way. Based on the existing configuration of the public right-of-way and of certain parcels along Snell Road, including 3701 Summerset Way, small edges or corners of parcels are necessary to be used to ensure the proper layout of the new public sidewalk. This easement satisfies that need for this parcel. The City will have continued rights to access the easement area to maintain the facilities. The City has been working with the property owner and the owner has agreed to grant the easement. The City Attorney's office has drafted the necessary easement documents. The Department of Public Works does not have concerns with the proposal and will work with the property owners to have the appropriate easement documents signed and recorded at the Winnebago County Register of Deeds upon Common Council approval. RECOMMENDATION/CONDITIONS Staff recommends approval of the acceptance of the proposed sidewalk easement as proposed. Item II F— Accept Sidewalk Easement— 3707 Summerset Way Paqe 1 Easement for Sidewalk Parcel 15-2708-0000 Owner: Blue Moon Holdings LLC Address: 3701 Summerset Way Part of Lot 1 of Block 2 of Windsor Green Subdivision located in the Southwest 1/4 of the Southwest 1/4 of Section 36 in Township 19 North, Range 16 East, Fifteenth Ward, City of Oshkosh, Winnebago County bounded and described as follows: All bearings and distances reference the 1992 WisDOT ROW Plat Project #6432-03-21. Commencing at the Southwest Corner of Section 36, Township 19 North, Range 16 East; Thence N 87°5547" E, 468.04 feet along the south line of the Southwest 1/4 of said Section 36 also being the centerline of Snell Road to a point believed to be the centerline of Summerset Way; Thence N 01°35'11" W, 75.00 feet along said centerline of Summerset Way; Thence S 51°14'03" W, 37.65 feet to a point on the west line of Summerset Way and the north line of Snell Road; Thence continuing S 51014'03" W, 20.91 feet along said north line of Snell Road; Thence S 87°5547" W, 63.88 feet along said north line of Snell Road to the point of beginning; Thence continuing S 87°55'47" W, 39.45 feet along said north line of Snell Road to the west line of Lot 1 of Block 2 of Windsor Green Subdivision; Thence N 02°27'40" W, 6.26 feet along the west line of said Lot 1 of Block 2; Thence S 83°03'33" E, 39.99 feet to the point of beginning on the north line of Snell Road.
