PURPOSE: ACCEPT STORM WATER EASEMENT AT 1658 MARICOPA
DRIVE
INITIATED BY: CITY OF OSHKOSH
PLAN COMMISSION RECOMMENDATION: Approved
BE IT RESOLVED by the Common Council of the City of Oshkosh that the City
hereby accepts a storm water easement at 1658 Maricopa Drive, per the attached, and the
proper City officials are authorized and directed to execute any and all documents
necessary for purposes of same.

BACKGROUND / ANALYSIS
The subject site is located at the southwest corner of Maricopa Drive and Allerton Drive. The
proposed easement is nearly an equilateral triangle,15.00' x 1500; x 15.11' and 97.92 square feet
in size, located at the northeast corner of the property. The easement will occur on currently
vacant private property just inside the sidewalk.
The City plans to install a storm sewer inlet and associate piping within this easement. The new
inlet will improve surface drainage from the owner's property and help the City's overall storm
water management system in the area. The City will have continued rights to access the
easement area to maintain the facilities. The City has been working with the property owner
and he has agreed to grant the easement. The City Attorney's office has drafted the necessary
easement documents. The Department of Public Works does not have concerns with the
proposal and will work with the property owners to have the appropriate easement documents
signed and recorded at the Winnebago County Register of Deeds upon Common Council
approval.
RECOMMENDATION
The Plan Commission recommended approval of the acceptance of the proposed storm sewer
easement at its May 19, 2020 meeting. Please see the attached staff report and meeting minutes
for more information.

GENERAL INFORMATION

Actions Requested:
The City of Oshkosh is requesting acceptance of an easement to allow placement of storm sewer
facilities at the northeast corner of 1658 Maricopa Drive.
Applicable Ordinance Provisions:

Property Location and Background Information:

Mr. Nau presented the item and reviewed the site and surrounding area as well as the land use
and zoning classifications in this area. The proposed easement is nearly an equilateral triangle,
15.00' x 15'00; x 15.11' and 97.92 square feet in size, located at the northeast corner of the
property. The City plans to install a storm sewer inlet and associate piping within this
easement. The new inlet will improve surface drainage from the owner's property and help the
City's overall storm water management system in the area. The City will have continued rights
