Chairperson Palmeri called the meeting to order at 4:00 pm. Roll call was taken and a quorum
declared present.
The minutes of March 18, 2020 and Closed Session March 18, 2020 were approved as distributed.

20-12 Approve Amendment No. 2 to TID Development Agreement with Merge, LLC
for Redevelopment of Parcels H, I and J within the Marion Road Redevelopment
Motion by Stam to move Res. 20-12
Seconded by Belter.
There were no comments or questions submitted by the public.
Mr. Belter inquired about the construction dates.
Mr. Davis stated the start dates is the big change in the development agreement amendment.
Construction is scheduled to begin on Parcel H this fall. Parcel J was going to be the first
development to occur but there are. The completion date for Parcels I and J as far as 2 years later. If
the projects are going to be delayed staff is want to hold the developers to a disincentive. If Merge
only does Parcel H, they can get up to 15% returned in project costs. If they develop 2 of the 3
parcels, they can get 20% of their project costs and if they do all three they will get 25% of the
project costs as originally agreed upon.
Mr. Hintz joined at 4:05
Mr. Davis stated Merge is heavily invested in this project and they are ready to close pending the
approval of the development agreement.

Community Garden Discussion
Ms. Palmeri stated several people have called and e-mail regarding community gardens and
making them more permanent. There is a current community garden in Menominee South
Neighborhood Association but the use is up in October due to development. There are some cities
that allow groups to use the vacant lots and if maintenance is kept up they have the option to
purchase.
Ms. Panek asked if the vacant lots are owned by the City that the people are interested in utilizing
for the community garden.
Ms. Palmeri stated they were not looking at any lot in particular but were seeing which lots may be
available or if they could partner with the City to acquire a lot for the gardens.
Mr. Davis stated there may be certain properties that the RDA or City owns that could be used for
the community gardens. The problem with RDA owned lot is that we cannot predict when
development will occur. Staff understands there is a lot of time, effort and money that is put into
the gardens to establish them.
Mr. Bermingham inquired what length of time is given for a community garden.
Mr. Davis stated the RDA allows year to year gardens.
Ms. Palmeri stated Steven's Park has had a successful community garden however they are in a
park and do not have to worry about losing their spot.
Mr. Davis stated since the RDA owns these properties, they can structure terms of a garden as the
board sees fit.
Mr. Lasky stated he would like to see a proposal for the community gardens that the RDA can
review and then structure the process.
Mr. Bermingham stated each parcel could be different in what would be allowed as far as length of
time or if the property could be purchased.
Ms. Panek stated Growing Oshkosh and GO-HNI could get involved.
Ms. Palmeri stated she believes there should be a process in place for the community gardens and
what properties could be available for this use.
Mr. Davis stated he would reach out to GO-HNI to see how they can partner with the
Neighborhood Associations and even those without Neighborhood Associations.
Mr. Belter made a motion for the Redevelopment Authority to convene into Closed Session pursuant to
Section 19.85(1)(G) of the Wisconsin State Statutes to confer with legal counsel who will render advice
concerning strategy to be adopted with respect to litigation in which the city is or is likely to become involved

related to Fox Valley Pro Basketball, Inc. and/or property located at 1212 South Main Street in the City of
Oshkosh.
Seconded by Stam.
There was no further discussion. The meeting adjourned at approximately 4:30PM.
