REDEVELOPMENT AUTHORITY MINUTES May 11, 2020 PRESENT: Thomas Belter, Jack Bermingham Steve Hintz, Jason Lasky, Lori Palmeri Susan Panek, Archie Starr STAFF: Allen Davis, Executive Director/Community Development Director; Darlene Brandt, Grants Coordinator; Andrea Flanigan, Recording Secretary Chairperson Palmeri called the meeting to order at 4:00 pm. Roll call was taken and a quorum declared present. The minutes of March 18, 2020 and Closed Session March 18, 2020 were approved as distributed. (Belter/Starr). 20-12 Approve Amendment No. 2 to TID Development Agreement with Merge, LLC for Redevelopment of Parcels H, I and J within the Marion Road Redevelopment Motion by Stam to move Res. 20-12 Seconded by Belter. There were no comments or questions submitted by the public. Mr. Belter inquired about the construction dates. Mr. Davis stated the start dates is the big change in the development agreement amendment. Construction is scheduled to begin on Parcel H this fall. Parcel J was going to be the first development to occur but there are. The completion date for Parcels I and J as far as 2 years later. If the projects are going to be delayed staff is want to hold the developers to a disincentive. If Merge only does Parcel H, they can get up to 15% returned in project costs. If they develop 2 of the 3 parcels, they can get 20% of their project costs and if they do all three they will get 25% of the project costs as originally agreed upon. Mr. Hintz joined at 4:05 Mr. Davis stated Merge is heavily invested in this project and they are ready to close pending the approval of the development agreement. The item was called. Motion carried 7-0. RDA Minutes May 11, 2020 Page 1 Community Garden Discussion Ms. Palmeri stated several people have called and e-mail regarding community gardens and making them more permanent. There is a current community garden in Menominee South Neighborhood Association but the use is up in October due to development. There are some cities that allow groups to use the vacant lots and if maintenance is kept up they have the option to purchase. Ms. Panek asked if the vacant lots are owned by the City that the people are interested in utilizing for the community garden. Ms. Palmeri stated they were not looking at any lot in particular but were seeing which lots may be available or if they could partner with the City to acquire a lot for the gardens. Mr. Davis stated there may be certain properties that the RDA or City owns that could be used for the community gardens. The problem with RDA owned lot is that we cannot predict when development will occur. Staff understands there is a lot of time, effort and money that is put into the gardens to establish them. Mr. Bermingham inquired what length of time is given for a community garden. Mr. Davis stated the RDA allows year to year gardens. Ms. Palmeri stated Steven's Park has had a successful community garden however they are in a park and do not have to worry about losing their spot. Mr. Davis stated since the RDA owns these properties, they can structure terms of a garden as the board sees fit. Mr. Lasky stated he would like to see a proposal for the community gardens that the RDA can review and then structure the process. Mr. Bermingham stated each parcel could be different in what would be allowed as far as length of time or if the property could be purchased. Ms. Panek stated Growing Oshkosh and GO-HNI could get involved. Ms. Palmeri stated she believes there should be a process in place for the community gardens and what properties could be available for this use. Mr. Davis stated he would reach out to GO-HNI to see how they can partner with the Neighborhood Associations and even those without Neighborhood Associations. Mr. Belter made a motion for the Redevelopment Authority to convene into Closed Session pursuant to Section 19.85(1)(G) of the Wisconsin State Statutes to confer with legal counsel who will render advice concerning strategy to be adopted with respect to litigation in which the city is or is likely to become involved RDA Minutes May 11, 2020 Page 2 related to Fox Valley Pro Basketball, Inc. and/or property located at 1212 South Main Street in the City of Oshkosh. Respectfully submitted, Allen Davis Executive Director/ Community Development Director REDEVELOPMENT AUTHORITY OF THE CITY OF OSHKOSH, WISCONSIN MAY 20, 2020 20-13 RESOLUTION (APPROVED LOST LAID OVER WITHDRAWN ) PURPOSE: APPROVE SPOT BLIGHT DESIGNATION; APPROVE ACQUISITION OF PROPERTY AT 1014 WISCONSIN STREET ($37,000) WHEREAS, the Redevelopment Authority of the City of Oshkosh was created to assist in the elimination and prevention of blight and blighting influences and to promote urban renewal; and WHEREAS, the property at 1014 Wisconsin Street exhibits conditions cited under Section 66.1333 (2m)3.(bm) of the Wisconsin Statutes that consider said property to be blighted; and WHEREAS, the Redevelopment Authority has conducted a public hearing to obtain comments and determine if said property is blighted; and WHEREAS, the owner has offered the property at 1014 Wisconsin Street to the Redevelopment Authority in the amount of $37,000 plus closing costs. NOW, THEREFORE, BE IT RESOLVED by the Redevelopment Authority of the City of Oshkosh that: 1. Findings and Determinations. It has been found and determined and is hereby declared that: (a) conditions of blight exist at the Property due to dilapidation and deterioration; and (b) the property is under raze orders by the City of Oshkosh due to property maintenance and code violations; and (c) the property is not within a designated redevelopment area but can be acquired if spot blighted by the Redevelopment Authority to eliminate slum and blight conditions in the neighborhood; and MAY 20, 2020 20-13 RESOLUTION CONT'D (d) the existing structure will be demolished and the lot sold at fair market value for residential purposes. 2. Spot Blight Designation. The Authority hereby finds that the Property is blighted in need of rehabilitation and blight elimination under the meaning in Section 66.1333 (2m)3.(bm) of Wisconsin Statutes. BE IT FURTHER RESOLVED that the proper officials are hereby authorized and directed to purchase 1014 Wisconsin Street in the amount of $37,000 plus closing costs and execute any and all documents necessary to consummate this transaction. Money for this purpose is hereby appropriated from Community Development Block Grant Funds. TO: City of Oshkosh Redevelopment Authority FROM: Allen Davis, Community Development Director DATE: May 13, 2020 SUBJECT: May 20, 2020 RDA Agenda items 20-13 Approve Spot Blight Designation; Approve Acquisition of Property at 1014 Wisconsin Street ($37,000) Background The City has been pursuing repair orders on this property and the property was presented as a possible acquisition and raze project. Code Enforcement has identified numerous code violations and property is currently vacant. Analysis The current owner purchased the property with city repair orders on it. There is no tenant and the parcel is surrounded by college rentals. The current owner approached City staff with an interest in selling the property to the City for $80,000. The fair market value of the property is $94,700. The condition of the structure no longer supports that value. City staff has completed a field inspection and recommends acquisition and eventual demolition. City staff settled on $37,000 for the purchase price. The long term plan for the property would be to land bank the property for the future redevelopment as a possible Oshkosh Housing Authority project designed for homeless college students. Fiscal Impact The RDA/City would use a portion of the CDBG central city blight elimination funds for acquisition ($37,000) and demolition (estimated up to $10,000). If the site is not acquired, the City will pursue a court order to raze the structure with City funds, and the owner would continue to own the lot. The City could be reimbursed for the demolition costs by a future lot buyer. On -going maintenance of the parcel would cost about $500/year for grass cutting/snow removal. Recommendation The RDA approves the Spot Blight Designation and Approves the Acquisition of 1014 Wisconsin Street for $37,000. TO: City of Oshkosh Redevelopment Authority FROM: Allen Davis, Community Development Director DATE: May 13, 2020 SUBJECT: May 20, 2020 RDA Agenda items 20-14 Approve Addendum to Offer to Purchase for an Extension to Purchase Vacant Property on South Main Street between Th Avenue And 8thAvenue; Sawdust District Lofts -Oshkosh, LLC ($1.00) Background The RDA issued a Request for Proposals (RFP) for the site in 2019 and received three proposals. Upon review of the proposals, the RDA selected the Sawdust Lofts proposal for redevelopment of the property. The Sawdust Lofts project proposes the construction of about 60 affordable housing units in a single building, containing underground parking, and a plaza structure facing Main Street. The developers also identified the WHEDA Low Income Housing Tax Credit (LIHTC) program as a piece of the financial plan. The developers applied for the WHEDA LIHTC programs. Unfortunately, WHEDA did not select the Sawdust Lofts for LIHTC funding in April, 2020. The developers would like to extend their offer to purchase to provide them time to acquire alternative financing and possible re -application for the tax credits. Analysis The proposed Sawdust Loft project was selected after considering the other proposals that were presented. The Sawdust Lofts appeared to best match the Sawdust District Plan with residential development, underground parking, and the public plaza fronting on South Main Street. The original development timing contingency for the project was obtaining financing and all necessary approvals for construction by October 31, 2020. The proposed extension would extend this date to April 30, 2021, or six months. The developers report that they plan to apply for additional grants and/or tax credits to help finance the proposed Sawdust Lofts project. Fiscal Impact The time extension to April 30, 2021 will not have a significant fiscal impact. The RDA will continue to maintain the property with grass cutting and snow removal. Recommendation The RDA approves Addendum to Offer to Purchase for an Extension to Purchase Vacant Property on South Main Street between 7th Avenue And 8th Avenue; Sawdust District Lofts -Oshkosh, LLC ($1.00) Addendum A to the Offer to Purchase Addendum attached to and made part of the Offer to Purchase dated November 26, 2019 made by the buyer, Northpointe Development Corporation with respect to the property at 707 South Main Street, Oshkosh, Wisconsin. Contingencies: Buyer's obligation to close this transaction is contingent upon the following: A. Buyer obtaining any other approvals from appropriate local, state or federal governments or government agencies having jurisdiction over the Property and all necessary support, permits, and licenses necessary for the Buyer's proposed use of an approximately 60-unit multi -family affordable housing project. This contingency shall be waived by Buyer in writing by 10/31/20 or this Offer shall be null and void. B. Buyer shall obtain a Phase I Environmental Report, at Buyer's expense, satisfactory to Buyer, This contingency shall be waived in writing by 6/15/20 or this Offer shall be null and void. C. Buyer obtaining approval for Buyer's application for certain WHEDA tax credits for the proposed use from the State of Wisconsin. This contingency shall be waived in writing by Buyer by 4/15/20 or this Offer shall be null and void. Main St. Oshkosh, Wl 0 LU z LLA x LU TO: City of Oshkosh Redevelopment Authority FROM: Allen Davis, Community Development Director DATE: May 12, 2020 SUBJECT: May 20, 2020 Agenda Items EXECUTIVE DIRECTOR'S REPORT Oshkosh Arena Update: Fox Valley Pro Basketball (FVPB) made the January, 2020 property tax installment and Special Assessments due. However, FVPB did not make the next installment. The City has sent a notice to FVPB. FVPB presented a plan to the bankruptcy court and the City Attorney is working with outside counsel regarding any RDA issues or concerns. The bankruptcy court is still working through the process. Healthy Neighborhood Initiative: Good Neighbor Grant program has been created in concert with OACF and GO-HNI. The grant program is hoping to improve 60 houses over the next 3 years with a total budget of $60,000. HNI funds contributed were $20,000 and leveraged $25,000 from the OACF and $15,000 from property owners. The next "Rock the Block" location which was Congress Field Neighborhood Association has been postponed until further notice. They have already identified more than 50 homes for improvements. Some of the projects will include City funds in addition to the renovation of the Congress Field Park. South Shore Redevelopment Area: 43 E Th Ave/Rec Lanes/706 S. Main Street — Demolition is complete. Environmental testing and minimal remediation is being done. Brooklyn Office condos may be interested in purchasing some parking lot area to expand their parking lot. 91h Ave. crushing pile - Staff has informed the contractor that the crushing and stockpiling on the site must end at the end of spring of 2020, when the 91h Ave. site is prepped and all crushing is completed for the site. Serwas Property — The RDA has closed on the property. Morgan District — The lighting is now energized and operable and the project is complete. Pioneer Area — Mr. Art Dumke continues to work with City staff to explore multiple development options and funding scenarios. The City drafted a TIF Plan for possible redevelopment and the City Council approved the TIF Plan on September 24, 2019. The site also qualifies for New Market Tax Credits and was included in the recently approved Opportunity Zones. 91h Avenue extension to CN Railroad — The street extension and undergrounding the overhead utilities has been submitted for a CIP request. The 91h Ave. extension and utility undergrounding was put in the CIP - Favorable Economic Conditions category in 2020. Pioneer Drive Riverwalk — Staff submitted the WisDNR grant application due May 1, 2020. The result of the application may be determined by the end of the year. Boatworks Property — The Option was granted to Morgan Partners. Marion & Pearl Redevelopment Area: Parcels H, I & J: The amended Development Agreement was approved by Council and has been executed. The Food Coop is planning to locate in Parcel H. Merge is working on environmental testing and architectural/engineering plans for the remaining parcels. The closing is scheduled by the end of May, 2020. Sawyer Street/Oshkosh Avenue Multi -modal Trail — WisDOT awarded the City $253,000 for extending the trail east from Punhoqua through Rainbow Memorial Park to the Sawyer Street/Oshkosh Avenue intersection in 2021. The City Council recently authorized hiring a contract engineer to work on design, engineering and permitting for the riverwalk through Rainbow Memorial Park starting in 2019. Staff is working on the environmental documents and the preliminary design for WisDOT approval.
