CITY OF OSHKOSH, 215 Church Avenue, Oshkosh,
1, a Wisconsin Municipal Corporation, herein takes the
regarding its interests in certain real property as identified below.
The City has an interest in certain property more
described as follows:
Lot 3 of Certified Survey Map No. 7068, recorded in the II
office of the Register of Deeds for Winnebago County, I`
Wisconsin on March 28, 2016, in Volume 1, page 7068,
as Document Number 1709684, being a re -division of Lot 2
of Certified Survey Map No. 6408, being a part of the South
'/z of the Northeast Y4 and part of the North %2 of the Southeast
'/4 of Section 23, Township 18 North, Range 16 East of the
Fourth P.M., First Ward, City of Oshkosh, Winnebago County,
Wisconsin.

2. The City's interest arises pursuant to an easement agreement dated May 9, 1963, and recorded with t
Winnebago County Register of Deeds on June 12,1963, as Document Number 310371, with the purpose
the easement to construct, operate, maintain, and repair a storm sewer and appurtenances.
A copy of the recorded easement is attached as Exhibit A, and incorporated herein.
4. The City of Oshkosh releases all right, title, and interest in the real property arising pursuant to t
recorded easement. Any improvements that have been installed or constructed pursuant to this recorc
easement are abandoned by the City and the easement rights are released without warranty, guaranty,
responsibility regarding the condition of the easement property or easement improvements therein.
5. This Release is limited to the rights pursuant to the identified recorded easement, and does not affect
other right, title, or interest, including other easements, agreements, encumbrances, and the like that of
the subject real property.

IHIS INDENTURE, made this �`�day of 1963
by and between COOK $ BROWN COMPANY, located at 146 Marion Road,
Oshkosh, Wisconsin, GRANTOR, and the CITY OF OSHKOSH, a municipal
corporation, in Winnebago County,.Wisconsin, GRANTEE.

IN CONSIDERATION of the sum of One (S1.00) Dollar and other
good and valuable consideration paid by GRANTEE, the receipt.
of which is hereby acknowledged, the GRANTOR does hereby grant,
bargain, sell and convey unto GRANTEE, its.successors ?nd assigns,
an EASEMENT and RIGHT-OF-WAY in, under and over the land hereinafter
described including the right to enter upon said land for the
purpose of constructing, maintaining, repairing and operating thereon
a storm sewer and appurtenant manhole, ..,together with the right to

Being a 20+ wide strip of land, the
centerline of which runs 27' southeast
of and parallel to the northwest line
of aforementioned Lot 3, extending
from the Southwest line of Marion Road
to the Fox River.
Upon exercising any of the rights herein granted; GRANTEE
shall cause the property, soil and grass to be repaired and placed in
a condition similar to its condition immediately prior thereto and
GRANTEE obligates itself to pay to GRANTORS, its.successors.and
assigns, all actual damages caused by reason. -of the installation,
operation, Tapeir or removal of said storm sewer and manhole, or the
installation and construction of subsequent manholes, storm. sewers,
or catch basins.
