ARTICLE I. PROTECT MANAGER A. Assignment of Project Manager. The CONSULTANT shall assign the following individual to manage the PROJECT described in this AGREEMENT: Jim Bachhuber — Midwest Area Stormwater Practice Leader B. Changes in Project Manager. The CITY shall have the right to approve or disapprove of any proposed change from the individual named above as Project Manager. The CITY shall be provided with a resume or other information for any proposed substitute and shall be given the opportunity to interview that person prior to any proposed change. ARTICLE II. CITY REPRESENTATIVE The CITY shall assign the following individual to manage the PROJECT described in this AGREEMENT: Dan Gabrilska — Civil Engineering Supervisor ARTICLE III. SCOPE OF WORK The CONSULTANT shall provide the services described in the CONSULTANT's Scope of Work. The CTIY may make or approve changes within the general Scope of Services in this AGREEMENT. If such changes affect CONSULTANT's cost of or time required for performance of the services, an equitable adjustment will be made through an amendment to this AGREEMENT. ARTICLE TV. STANDARD OF CARE The standard of care applicable to CONSULTANT's services will be the degree of skill and diligence normally employed by professional consultants or consultants performing the same or similar services at the time said services are performed. CONSULTANT will re -perform any services not meeting this standard without additional compensation. ARTICLE V. OPINIONS OF COST FINANCIAL CONSIDERATIONS AND SCHEDULES In providing opinions of cost, financial analyses, economic feasibility projections, and schedules for the PROJECT, CONSULTANT has no control over cost or price of labor and materials; unknown or latent conditions of existing equipment or structures that may affect operation or maintenance costs; competitive bidding procedures and market conditions; time or quality of performance by operating personnel or third parties; and other economic and operational factors that may materially affect the ultimate project cost or schedule. Therefore, it is understood between the parties the CONSULTANT makes no warranty the CITY's actual project costs, financial aspects, economic feasibility, or schedules will not vary from CONSULTANT's opinions, analyses, projections, or estimates. ARTICLE VI. RECORD DRAWINGS Record drawings, if required, will be prepared, in part, on the basis of information compiled and furnished by others. CONSULTANT is not responsible for any errors or omissions in the information from others the CONSULTANT reasonably relied upon and are incorporated into the record drawings. ARTICLE VII. CITY RESPONSIBILITIES The CITY shall furnish, at the CONSULTANT's request, such information as is needed by the CONSULTANT to aid in the progress of the PROJECT, providing it is reasonably obtainable from City records. ASBESTOS OR HAZARDOUS SUBSTANCES If asbestos or hazardous substances in any form are encountered or suspected, CONSULTANT will stop its own work in the affected portions of the PROJECT to permit testing and evaluation. If asbestos is suspected, CONSULTANT will, if requested, manage the asbestos remediation activities using a qualified subcontractor at an additional fee and contract terms to be negotiated. If hazardous substances other than asbestos are suspected, CONSULTANT will, if requested, conduct tests to determine the extent of the problem and will perform the necessary studies and recommend the necessary remedial measures at an additional fee and contract terms to be negotiated. The CITY recognizes CONSULTANT assumes no risk and/or liability for a waste or hazardous waste site originated by other than the CONSULTANT. ARTICLE IX. CITY'S INSURANCE The CITY will maintain property insurance on all pre-existing physical facilities associated in any way with the PROJECT. The CITY will provide (or have the construction contractor(s) provide) a Builders Risk All Risk insurance policy for the full replacement value of all project work including the value of all onsite CITY -furnished equipment and/or materials associated with CONSULTANT's services. Upon request, the CITY will provide CONSULTANT a copy -of such policy. ARTICLE X. TIME OF COMPLETION The work to be performed under this AGREEMENT shall be commenced and the work completed within the time limits as agreed upon in the CONSULTANT's Scope of Work. The CONSULTANT shall perform the services under this AGREEMENT with reasonable diligence and expediency consistent with sound professional practices. The CITY agrees the CONSULTANT is not responsible for damages arising directly or indirectly from any delays for causes beyond the CONSULTANT's control. Page 3of7 by the CITY, or discovery of any hazardous substances or differing site conditions. If the delays resulting from any such causes increase the time required by the CONSULTANT to perform its services in an orderly and efficient manner, the CONSULTANT shall be entitled to an equitable adjustment in schedule. ARTICLE XI. COMPONENT PARTS OF THE AGREEMENT This AGREEMENT consists of the following component parts, all of which are as fully a part of this AGREEMENT as if herein set out verbatim, or if not attached, as if hereto attached: 1. ARTICLE XI[. PAYMENT A. The Agreement Sum. The CITY shall pay to the CONSULTANT for the performance of the AGREEMENT the total sum as set forth below, adjusted by any changes hereafter mutually agreed upon in writing by the parties hereto: • Time and Materials Not to Exceed $165,920 (One Hundred Sixty Five Nine Hundred Twenty Dollars). • Attached fee schedule(s) shall be firm for the duration of this AGREEMENT. B. Method of Payment. The CONSULTANT shall submit itemized monthly statements for services. The CITY shall pay the CONSULTANT within thirty (30) calendar days after receipt of such statement. If any statement amount is disputed, the CITY may withhold payment of such amount and shall provide to CONSULTANT a statement as to the reason(s) for withholding payment. C. Additional Costs. Costs for additional services shall be negotiated and set forth in a written amendment to this AGREEMENT executed by both parties prior to proceeding with the work covered under the subject amendment. Indirect costs such as computer time, printing, copying, cell phone charges, telephone charges, and equipment rental shall be considered overhead and shall not be invoiced separately to the PROJECT. E. Expenses. Expenses may be billed with up to a maximum of 10% mark-up. All invoices with expenses shall include supporting documentation of the expense. Failure to include the supporting documentation will result in the reduction of payments by the amount of those expense(s) not including documentation. ARTICLE XIII. STANDARD PROVISIONS The CONSULTANT agrees that, in all hiring or employment made possible by or resulting from this AGREEMENT, there will not be any discrimination against any employee or applicant for employment because of race, color, religion, sex, sexual orientation, gender identity, or national origin. ARTICLE XIV. HOLD HARMLESS The CONSULTANT covenants and agrees to protect and hold the City of Oshkosh harmless against all actions, claims, and demands to the proportionate extent caused by or resulting from the intentionally wrongful or negligent acts of the CONSULTANT, his/her agents or assigns, his/her employees, or his/her subcontractors related to the performance of this AGREEMENT or be caused or result from any violation of any law or administrative regulation, and shall indemnify the CITY for all sums including court costs, attorney fees, and damages of any kind which the CITY may be obliged or adjudged to pay on any such claims or demands upon the CTTY's written demand for indemnification or refund for those actions, claim, and demands caused by or resulting from intentional or negligent acts as specified in this paragraph. Subject to any limitations contained in Sec. 893.80 and any similar statute of the Wisconsin Statutes, the CITY further agrees to hold CONSULTANT harmless from any and all liability, including claims, demands, losses, costs, damages, and expenses of every kind and description (including death), or damages to person or property arising out of re -use of the documents without consent where such liability is founded upon or grows out of the acts or omission of any of the officers, employees or agents of the City of Oshkosh while acting within the scope of their employment. ARTICLE XV. TERMINATION A. For Cause. If the CONSULTANT shall fail to fulfill in timely and proper manner any of the obligations under this AGREEMENT, the CITY shall have the right to terminate this AGREEMENT by written notice to the CONSULTANT. In this event, the CONSULTANT shall be entitled to compensation for any satisfactory, usable work completed. B. For Convenience. The CITY may terminate this AGREEMENT at any time by giving written notice to the CONSULTANT no later than ten (10) calendar days before the termination date. If the CITY terminates under this paragraph, then the CONSULTANT shall be entitled to compensation for any satisfactory work performed to the date of termination. This document and any specified attachments contain all terms and conditions of the AGREEMENT and any alteration thereto shall be invalid unless made in writing, signed by both parties and incorporated as an amendment to this AGREEMENT. ARTICLE XVII. RE -USE OF PROJECT DOCUMENTS All reports, drawings, specifications, documents, and other deliverables of CONSULTANT, whether in hard copy or in electronic form, are instruments of service for this PROJECT, whether the PROJECT is completed or not. The CITY agrees to indemnify CONSULTANT and CONSULTANT's officers, employees, subcontractors, and affiliated corporations from all claims, damages, losses, and costs, including, but not limited to, litigation expenses and attorney's fees arising out of or related to the unauthorized re -use, change, or alteration of these project documents. ARTICLE XVIII. SUSPENSION DELAY OR INTERRUPTION OF WORK The CITY may suspend, delay, or interrupt the services of CONSULTANT for the convenience of the CITY. BACKGROUND OSHKOsn, WISC NSRKS The City of Oshkosh's stormwater discharge quality is regulated under a Wisconsin Department of N Natural Resources (WDNR) issued Municipal Separate Storm Sewer System (MS4) permit. The permit was originally issued in 2006, reissued in 2014, and the third permit term began on May 1, 2019. The permit requires the City to conduct various stormwater management programs. The City of Oshkosh's MS4 Permit references the pending Total Maximum Daily Loads for Total Phosphorus and Total Suspended Solids Upper Fox and Wolf Basins (TMDL Plan) for stormwater pollution reduction targets. The 2019 MS4 permit (Appendix C) specifies a schedule and requirements for the City to meet the TMDL pollution reduction requirements by reachshed. This scope of work will fulfill the TMDL stormwater planning requirements for the City of Oshkosh. The work will build upon the information generated during the previous studies: the 2008 Citywide Stormwater Management Plan and Ordinance Development (2008 SWMP), and the 2014 City of Oshkosh Citywide Stormwater Quality Management Plan Update (2014 SWMP) and minimize any duplication of effort. This study will update the 2014 SWMP for the existing urban areas and develop a new plan for the new urban areas developed after September 2014. The study will also update the stormwater pollution loading analysis by each TMDLsubbasin. Because previous planning efforts determined that the City has exceeded the NR151 Developed Urban Area Standard of 20 percent reduction of Total Suspended Solids (TSS) Citywide, this plan will only focus on the TMDL compliance evaluations. The plan will be conducted in coordination with the WDNR, so the plan meets MS4 permit TMDL planning requirements. B. SCOPE OF WORK Task 1.0 Project Meetings and Project Management Meetings with City staff and Brown and Caldwell (BC) are budgeted to allow for full communication during the project. An initial kick-off meeting will be held with City staff to finalize the project goals, communications, schedule, and procedures. Two (2) additional face-to-face meetings with City staff will be scheduled as determined best during the project (for a total of up to three face-to-face meetings). WDNR staff will be invited to attend these meetings. Additional face-to-face meetings will include two meetings with the City's Stormwater Utility Appeals Board to provide updates and gain feedback on the project's modeling analysis and recommendations. Other forms of communications will include web -based meetings, conference phone calls, and emails as necessary to conduct the project in an efficient manner. Work under this task includes all meeting preparation, attendance, and meeting summary notes. The budget for this task allows for a total of five (5) face-to-face meetings and four (4) web -based meetings over the course of the project. Task 2.0 Review Storm Sewer System Map BC will review the existing storm sewer system map as provided by the City to check for compliance with the requirement under Section 2.8 of the 2019 MS4 General Permit. Task 3.0 Re-establish No Controls Stormwater Pollutant Load Using Most Recent WDNR Guidance BC will conduct the following subtasks to re-establish the City's no controls stormwater pollutant load in keeping with the MS4 - TMDL Guidance. The loading analysis will be conducted for TSS and total phosphorus (TP). 3.1 Review and Modify GIS data per WDNR Guidance Oshk Final Scope of Work 01_11.2020 City of Oshkosh 2020/2021 Citywide Stormwater Management/ TMDL Compliance Plan Scope of Work BC will compare the analyzed area in the 2014 SWMP Update to the area that must be used for purposes of TMDL compliance. BC will modify the GIS data where needed. BC will rely on City staff review of data to aid in the process and approve the revisions. Areas that will be reviewed for inclusion within the TMDL compliance area include: • NR 216 industrial permitted land • Agricultural land as of the "cut-off date" of the TMDL stormwater management plan • WDOT right-of-way areas within the municipal boundary (eligible state highways within the City) • County -owned or operated MS4s within the City • UW-Oshkosh MS4 area • Riparian lands with no MS4 discharge • Internally -drained areas meeting WDNR guidance definitions. Additionally, new areas developed (urbanized) since October 2004 will be added to the GIS coverage and categorized appropriately for pollution modeling purposes. 3.2 Re -Run No Controls Conditions The City of Oshkosh is subject to two permit requirements relative to MS4 pollution loading: 1) TSS reduction requirements as stated in Section 2.7 of the 2019 permit and; 2) TSS and Total Phosphorus (TP) reduction requirements as stated in Appendix C of the MS4 Permit and in relation to the Upper Fox/ Wolf Basins TMDL. The WinSLAMM stormwater pollution model (version 10.4 or newer) will be used to analyze the stormwater pollution discharged from the City's regulated MS4 for the TMDL permit requirements. BC will conduct this analysis in accordance with Wisconsin Administrative Code and current WDNR guidelines. The results for this task will be reported for both TSS and TP annual loading by TMDL subbasin. Task 4.0 Re-establish Existing Conditions TSS and TP Loads BC will conduct the following subtasks to re -analyze the pollution reduction achieved by the City's existing Stormwater Control Measures (SCMs). Measures in existence or under design as of January 2020 will be included in the analysis. The same version of WinSLAMM used for no controls conditions will be utilized for the existing conditions analysis. 4.1 Update Street Cleaning Modeling BC will meet with City staff to verify the current mechanical and high efficiency sweeper use, routes, parking controls, and historic trends for sweeping. The City's street cleaning schedule and current equipment will be updated to reflect current conditions based on the outcome of the meeting, and remodeled. 4.2 Update Catch Basin with Sump Modeling The City installs catch basins with sumps as part of the storm sewer drainage system installed during road construction projects. The catch basin with sump modeling will be updated and incorporate identified catch basins with sumps installed as of January 2020. 4.3 Update Grass Swale Modeling At the time of the 2014 SWMP Update, the City had a number of grass swales that treat stormwater runoff through settling of particulate pollutants and through infiltration of stormwater. Each of the Swale categories was assigned an infiltration rate based on double ring infiltration tests and agreed to by the WDNR. The Swale locations and drainages areas will be reviewed, and the modeling will be updated based on the 2014 measured infiltration rates. Oshk Final Scope of Work 01 11_2020 2 City of Oshkosh 2020/2021 Citywide Stormwater Management/ TMDL Compliance Plan Scope of Work 4.4 Evaluate Structural Stormwater Control Measures Sixty-one (61) structural SCMs were modeled in WinSLAMM 10.0 and included in the 2014 SWMP Update. These SCMs included wet detention basins, biofilters, and stormwater lift stations. The 2014 model results for these SCMs will be incorporated into the 2020 SWMP analysis. 4.4.1 Publicly -Owned SCMs Installed since 2014 Seventeen (17) additional publicly -owned, structural SCMs have been constructed since the 2014 SWMP Update. UW-O Tennis Courts BC will review the existing WinSLAMM models for each SCM listed above for use in the 2020 SWMP. Each model will be verified and/or updated if necessary. 4.4.2 Private SCMs Installed Since 2014 The City will provide data on all private SCMs installed between December 2014 - January 2020. For each private SCM, the data will include: location of SCM (parcel ID), type of SCM, land area treated by the SCM, and the modeled post -treatment pollutant load reduction for TSS and TP as approved by the City'ssite plan review process. BC will incorporate the data provided by the City into the final analysis of existing conditions pollutant load control. Results will be reported by TMDL reachshed. 4.5 Summarize Existing Results BC will consolidate annual loadings of stormwater pollutants for TSS and TP for the City's existing SCMs as described in subtasks 4.1, 4.2, 4.3, and 4.4. The results will be presented in the following formats: 1) Tabular a. No Controls TSS and TP load for each TMDL reachshed b. GIS maps of existing (With Controls) TP load by watershed, and by load/acre/yr for each TMDL reachshed The results will be compared to the TSS and TP reduction requirements as stated in the Upper Fox / Wolf Basins TMDL. Task 5.0 Evaluation of Proposed Stormwater Control Measures The 2014 SWMP Update included a comprehensive review of potential proposed SCMs that could be implemented to help meet water quality targets. Some components from that analysis will be updated and other new components will be added with the 2020 Plan Update. The 2014 SWMP Update evaluated several potential new SCMs for pollution control and feasibility. BC will update proposed management measures identified in the 2014 SWMP and report pollutant reduction results (TSS and TP) as described below in subtasks 5.1- 5.10. Results will be reported by TMDL Reachshed. 5.1 Evaluate Existing Dry Detention Basin Retrofit Five (5) dry detention basins were included in the final evaluation during the 2014 SWMP Update for feasibility of conversion to wet detention basins. The 2014 evaluation of the five detention basins will be updated. 5.2 Evaluate Street Cleaning Alternatives The City is currently conducting a street cleaning program that was shown in the 2014 SWMP to be optimized for pollutant reduction. No further analysis of alternative street cleaning programs will be conducted; however, the current street cleaning program will be accounted for in the analysis. 5.3 Evaluate Enhanced Leaf Pick -Up Program. The WDNR released interim guidance on how TP credit may be taken for leaf pick-up programs if the program and conditions meet specific criteria. BC will identify and assess the areas of the City that meet the guidance criteria and determine the level of TP reduction that would be achieved if the City's leaf pickup program meets the guidance requirements. The TP reductions will be identified by the TMDL reachsheds. 5.4 Evaluate New Wet Detention Basins Twelve (12) new wet detention basins were included in the final evaluating of the 2014 SWMP Update. Since the completion of the plan, three (3) of the wet detention basins were implemented (South Park Expansion, Libbey Ave. / N. Main St., and 9th Ave. / Washburn) and will be analyzed under Task 4. BC will review and re -model as needed the nine (9) potential new wet detention ponds identified in the 2014 SWMP Update that were not implemented and these nine (9) wet detention ponds will be reviewed for feasibility of implementation as part of this task. Additionally, new regional wet detention ponds will be identified, where appropriate.' Up to five (5) new regional wet detention ponds will be analyzed (WinSLAMM model and feasibility analysis) under this task. 5.5 Evaluate Enhanced Treatment for Phosphorus Removal Some wet detention basins can be enhanced using a coagulant treatment system to increase the amount of TSS and TP captured in the basin. BC will evaluate up to four (4) existing wet detention basins for retrofit with a coagulant treatment system. The wet detention basins will be identified based upon review of screening criteria with City staff during the initial stages of the project. The Oshk Final Scope of Work 01_11_2020 City of Oshkosh 2020/2021 Citywide Stormwater Management/ TMDL Compliance Plan Scope of Work evaluation will include feasibility of retrofit, planning level costs, and expected additional pollution reduction. 5.6Incorporate Projected Proposed New Development and Redevelopment Pollution Control New land development and redevelopment are subject to the post -construction standards of NR151 and the City's Municipal Ordinance (Chapter 14). BC will work with the City to identify an average acreage of annual new development and redevelopment. Pollution reduction based on the local ordinance requirements will be applied to these areas. The annual new development and redevelopment will then be projected 10, 20, and 30 years into the future. This will help the City understand the impact of new development and redevelopment on meeting long-term pollution reduction targets. An additional analysis under this task will estimate the increase in pollution control (TSS and TP) that could be achieved if the City revised the current pollution control standards (in City Ordinance Chapter 14) to higher levels. Two (2) iterations of increased TSS and TP reduction levels for new development and redevelopment will be analyzed and reported. 5.7 Update Engineered Swales Analysis During the 2014 SWMP Update, the existing swales within the City were evaluated for retrofit to engineered swales. This analysis will be updated for the 2020 SWMP Update using the assumptions described in the 2014 SWMP Update and the current areas treated by grass swales. 5.8 Update Biofilters and Rain Gardens Analysis During the 2014 SWMP Update, the addition of new biofilters and rain gardens was evaluated for select areas of the City. This analysis will be updated for the 2020 SWMP Update using the assumptions described in the 2014 SWMP Update. 5.9 Update SCM Planning Level Cost Estimates The 2014 SWMP Update included planning -level cost estimates for the proposed SCMs. The cost estimates will be updated for the SCMs proposed in this study with information from the most recent bid tabulations for other stormwater projects within the City and surrounding area. Unit costs will be reviewed and approved by the City. 5.10 Summarize Impacts of Proposed Management Measures The combination of all evaluated SCMs under this Task will be evaluated as to the potential pollutant reductions (TSS and TP) by TMDL reachshed. This analysis will show the progress that can reasonably be made to meet the Upper Fox / Wolf River Basins TMDL TSS and TP WI -As for each reachshed. Task 6.0 Develop TMDL Implementation Plan Following evaluation of the proposed SCMs, an implementation plan will be developed that identifies both short- and long-term activities. The implementation plan will include a schedule that will meet the requirements outlined in the draft 2019 MS4 permit. Task 7.0 Verify Language for Construction Site Erosion Control and Post -Construction Stormwater Management Ordinances. The City of Oshkosh's erosion control and post -construction stormwater management ordinance (Chapter 14) was updated in August 2014 to comply with the requirements of the 2014 MS4 Permit (Permit Sections 2.4.1.3, 2.5.1.3, and 2.5.1.4. BC will meet with City staff to confirm that no revisions to the current ordinance is required per the MS4 Permit. Task 8.0 Prepare Updated Stormwater Management Plan for TMDL Compliance Oshk Final Scope of Work 01_11_2020 5 City of Oshkosh 2020/2021 Citywide Stormwater Management/ TMDL Compliance Plan Scope of Work BC will prepare a plan that: 1) documents modeling methodology, 2) compiles no -controls annual TSS and TP pollution loadings into appropriate tabular format(s) per the MS4 Permit requirements, 3) documents the pollution control (TSS and TP) achieved by existing management measures, and 4) identifies the potential new SCMs' pollutant removal efficiency and cost. Finally, the report will provide a direction and compliance schedule for the City to meet the TMDL requirements as contained in the MS4 Permit. The report will also contain maps displaying the results of the modeling and the potential locations of proposed SCMs. The City will review this report and provide comment to BC before it is finalized. The report and WinSLAMM modeling information will also be provided to the WDNR for review and comment. BC will provide 2 hard copies and an Adobe formal file of the draft report for City review. BC will provide three (3) hard copies and an Adobe format file of the final report to the City. In addition, BC will provide GIS files prepared under this scope of work as requested by the City. Task 9.0: Site Plan Scale Analysis for Increased TSS and TP Reduction from New Development and Redevelopment Task 5.6 describes an analysis to estimate the additional TSS and TP reduction if the current Chapter 14 minimum control levels were increased. Task 9.0 would use those potential elevated pollutant control targets and determine the impact on SCM sizing for selected existing new development and redevelopment sites. BC will work with the City to select one (1) new development site plan, and one (1) redevelopment site plan for this analysis. The existing SCMs on each site plan (which were designed to meet the current Chapter 14 pollution reduction targets) will be modified and re -modeled in WinSLAMM to determine the feasibility of achieving the elevated TSS and TP reduction goals determined under Task 5.6. It is assumed that each site plan will be modeled for two (2) increased levels of TP control. The result of each analysis will be a schematic drawing of the increased SCM footprint to meet the high TP control targets, and a cost estimate for each SCM. The results of this analysis will be documented and incorporated into the Stormwater Management Plan described under Task 8.0. Task 10: Field Infiltration Testing of Wittman Airport Grass Swales. The 2014 SWMP accounts for pollution control from grass swales located on Wittman Airport; however, infiltration testing was not conducted on these grass swales. BC will conduct field testing at no more than three (3) locations on Wittman Airport grass swales in accordance with WDNR guidance. BC will also verify the geometry of the grass swales located on the airport property and update the WinSLAMM model for these SCMs using the field -measured infiltration rates. The results of this analysis will be documented and incorporated into Task 4.3 and the Stormwater Management Plan under Task 8.0. C. ASSUMPTIONS 1. The City shall furnish BC all available maps, orthophotographs, stormwater conveyance system drawings, stormwater management plans, parcel graphical and tabular data, previous stormwater management planning data (including GIS and WinSLAMM files from the 2014 Citywide Plan), and other relevant stormwater management data (including GIS and WinSLAMM files generated after the 2014 Citywide Plan), all of which may be relied upon without independent verification in performing the Scope of Work. It is also assumed that the above information will be provided at no cost to the project. Data files will be provided digitally to BC if available or paper copy format (if a digital format is not available). Oshk Final Scope of Work 01_11_2020 City of Oshkosh 2020/2021 Citywide Stormwater Management/ TMDL Compliance Plan Scope of Work 2. Some information provided by the City may be inaccurate or unreliable. BC cannot be responsible for inaccuracies in the data supplied by the City. Field verification of the data is not included in the Scope of Work. 3. Preparation of design plans, specifications, or construction documents are not included in this scope of work. 4. Except for Task 10, the scope of work does not include any field investigations including, but not limited to: wetland delineations, environmental investigations, floodplain mapping, endangered species investigation, or archeological investigations. 5. To conduct Task 10, the City will acquire safe access from Winnebago County and/or Wittman Airport authorities so that BC may conduct the field work. The field work will be accomplished in one day and assumes that the City will arrange a water source for the infiltration testing at no cost to the project. 6. The scope of work will be conducted following available WDNR guidance and the requirements of the WPDES General Permit in effect at the time of the study. General Permit requirements only include targeted pollutant reductions for TSS and TP. D. BUDGET AND COMPENSATION The total project budget will be invoiced per the contract's terms and conditions and the budget will not exceed $165,920 without written approval from the City of Oshkosh.
