RE: COVID— 19,Temporary sign regulations and Select Certified Survey Maps
Temporary modifications of sign regulations:
In order to aid businesses during the COVID-19 pandemic, the City of Oshkosh should allow businesses
increased opportunity and flexibility with temporary signage code modifications.
1) Window signs—A business may temporarily erect window signs exceeding the presently allowed
33 percent of the individual glass area contained within mullion or frame.
2) Temporary signs, banners and sandwich boards — A business may erect one temporary sign,
banner, or sandwich board on or in front of its establishment. No permit, fee or application will
be required for this type of temporary sign during the COVID-19 health emergency. This
temporary sign must comply with all Building Code Standards and with the Americans with
Disabilities Act(ADA).
Select Certified Survey Map (CSM):
In response to the Common Council's guidelines that agendas for Commission meetings be limited to
matters requiring action reasonably necessary for response to the emergency or reasonably necessary for
continuity of services, I propose we temporarily allow Community Development Staff be allowed to
administratively approve select CSM's. This will allow us to continue efficiently serving property
owners within the City of Oshkosh, while minimizing the potential delays and adhering to the above
referenced Council guidelines. Wisconsin Statute 236.34 regulates the CSM approval process. State law
only requires Plan Commission or Common Council to approve CSM's which dedicate streets, other
lands to the public or grant easements. Section 236.34 (1m) (f) further requires the City take final action
on a CSM within 90 day of the receiving the application,failure to act within 90 days constitutes approval.
Further, section 30-443(D)3 of the City of Oshkosh code requires the City take action within 30 days on
receiving the application for CSM.With that being said,CSM's are not an arbitrary approval process,the
platting statutes are very specific in what is required for approval of a CSM and if all requirements are
met, the CSM shall be approved. Examples of administratively approved CSM's are those that combine
lots, split parcel or move lot lines between neighbors.
