HomeMy WebLinkAbout40. 20-140 MARCH 24, 2020 20-140 RESOLUTION (CARRIED LOST LAID OVER WITHDRAWN ) PURPOSE: APPROVE SPECIAL EVENT / KELLY'S BAR TO HOLD THEIR GRADUATION BEER GARDEN/MAY 15 & 16, 2020 INITIATED BY: CITY ADMINISTRATION WHEREAS, the City of Oshkosh has received a special event application from (Daniel Schultz) to utilize Kelly's Bar for their Graduation Beer Garden on Friday,May, 15 and Saturday, May 16, 2020; and WHEREAS, Kelly's Bar, through their special event application and letter have requested that amplified music be extended until 12:00 a.m. on Saturday,May 16 and 12:00 a.m. on Sunday, May 17; and WHEREAS, the City of Oshkosh has adopted a beer garden ordinance which prohibits amplified sound or music after 11:00 p.m. on Saturday nights; NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Oshkosh that approval is granted to Kelly's Bar (Daniel Schultz) 219 Wisconsin Street to hold their Graduation Beer Garden on Friday, May 15, from 11:00 a.m.to Sunday,May 17, 2020 (with the actual event times being Friday,May 15 from 11:00 a.m.to Saturday,May 16, 12:00 a.m. and Saturday, May 16 from 11:00 a.m. to Sunday, May 17, 12:00 a.m.), in accordance with the municipal code and the attached application, with the following exceptions/conditions: A. An exception to the provisions of 4-24(D)(2)of the City of Oshkosh Municipal Code is granted to allow amplified music until 12:00 a.m. for both event nights. B. C. BE IT FURTHER RESOLVED that as a condition of approval, the Event Organizer shall pay the City's actual costs for extraordinary services. Approval of this request MARCH 24, 2020 20-140 RESOLUTION CONT'D shall not be interpreted as approval to conduct the event during any period of emergency order or declaration prohibiting such event. Approval of this event shall not be interpreted to supersede any emergency order or declaration applicable to such event and all events shall remain subject to all applicable ordinances, orders, declarations and requirements for public gatherings. The waiver would be to have amplified music extended one hour, from 11 pm to midnight on Friday May 15th and Saturday May 16th. The pattern of students going out later in the evening has made it more necessary to make the bands price reasonable.. The band is booked from 8-11 normally, but the extra hour allows them to have a break in the middle, and the ability to interact with the crowd better. Majority of the attendees do not arrive until after 9, so the extra hour allows the band to also start their set later. Beer Gardens has been an annual event for many years in the beginning and end of the school year. The waiver has traditionally been approved. Mainly due to the reason of Kelly's Bar being located in an area of primarily late night businesses, and college living. Please consider my request. Thank you.
