PURPOSE: APPROVE CHANGE ORDER NO. 1 WITH LINNCO FOR
ADDITIONAL DEMOLITION IN THE EAST 700 BLOCK OF SOUTH
MAIN STREET (+$242,100); APPROVE AMENDMENT TO
PROFESSIONAL SERVICE AGREEMENT WITH AECOM FOR
DEMOLITION MANAGEMENT AND ENVIRONMENTAL ISSUES
IN THE EAST 700 BLOCK OF SOUTH MAIN STREET (+$40,820);
APPROVE BUDGET AMENDMENT
INITIATED BY: DEPARTMENT OF COMMUNITY DEVELOPMENT
WHEREAS, the Redevelopment Authority has recently acquired 706 S. Main
Street; and
WHEREAS,a change order for additional demolition in the East 700 Block of South
Main Street will allow for the contractor to remain on site to continue demolition; and
WHEREAS, an amendment to AECOM's professional service agreement is
necessary for the additional demolition management and environmental management in
the E. 700 Block of South Main Street.
NOW THEREFORE BE IT RESOLVED by the Common Council of the City of
Oshkosh that the following change order is hereby approved and the proper City officials
are authorized to execute any and all documents necessary for purposes of same.

BE IT FURTHER RESOLVED that in order to permit the project to be completed
in a timely manner and on schedule, the City Manager, or his designee, is hereby
authorized to approve future change orders in an amount not to exceed the available
contingency funds.
BE IT FURTHER RESOLVED by the Common Council of the City of Oshkosh that
an amendment to the professional service agreement with AECOM is hereby approved
to provide demolition management and environmental management in the amount of
$40,820 and the proper City officials are authorized and directed to enter into an
appropriate agreement for purposes of same and to take those steps necessary to
implement the terms and conditions of the agreement as amended.
BE IT FURTHER RESOLVED that the following 2019 Capital Improvements
Budgets are hereby amended to fund said change order and professional service
agreement amendment:

Budget Amendment
BACKGROUND
The City has acquired 706 South Main Street recently as was consistent with the Southshore
Redevelopment Plan and TIF #20. Phase 1 Environmental Site Assessments (ESA) have been
completed. The demolition of the structures by LinnCo must be completed in order to perform
Phase 2 Environmental testing by AECOM. All these efforts are in anticipation of issuing a
Request for Proposals (RFP) for the redevelopment of this area in the near future.
ANALYSIS
The proposed demolition contract change order will remove the building and any hard surfaces
on the property. This will also remove the underground storage tanks uncovered during the
demolition process. Available materials will be recycled, including the concrete and asphalt
which will be crushed and reused for back fill as needed, and stockpiled for future use on 9t''
Ave and/or the Pioneer Drive riverwalk. The contract also requires the grading, top soil and
seed and hydro mulch so that the site will be development ready and attractive.
FISCAL IMPACT
Cost savings from the 2019 CIP Rec Lanes funding to hire a structural engineer were not needed
since acquiring 706 S Main St. Those funds were used for the acquisition of 706 S. Main and can
be used for the additional demolition. The funding for the demolition project is available in the
CIP from TIF #20 funds for demolition of the surrounding buildings ($108,000) and Scattered
Sites ($174,920).

Potential Fuel Oil Subsurface Clean up at 706 S. Main Street
Reason for Modification(s)
An underground fuel oil tank assumed to have been used for suppling a heating system was discovered
during demolition of the office building at 43 E. 7th Avenue. The steel tank had several holes in it, and fuel
oil apparently leaked into the subsurface. The tank was properly decommissioned but the soil surrounding
the tank appeared to be severely impacted with fuel oil. AECOM recommended removal of the impacted
material to limit future liability. LinnCo provided an estimate to load and transport 200 tons of impacted
material to Waste Management's Valley Trail Landfill, Berlin Wisconsin.
In addition, there is a potential for a fuel oil tank associated subsurface clean up with the Luecks Facility.
This budget includes and estimated 200 tons for this potential cleanup also.
AECOM recommends approval as the quote is acceptable based on a comparison of similar
project costs.Time and Materials Not-to-Exceed$8,100.00.

Unanticipated and Buried Concrete Structures Encountered and Warning Fabric Permit Requirement

Unknown Concrete Floor Slab/Gas Line and Valve
During demolition of 43 E. 7'h Avenue buildings, a second layer of concrete floor slab was encountered
under the building floor slab. This concrete slab was approximately 8"thick and reinforced. In addition, a
8"diameter natural gas line and valve was identified. This gas line and valve had to be investigated in an
effort to determine if it was decommissioned. This slab and gas line/valve were not apparent or
anticipated during the bidding process.
Unknown Former Foundry Machine Foundations
During demolition of 43 E. 7t'Avenue buildings, a second layer of concrete floor slab was encountered
under the building floor slab. Under this second layer of concrete several massive historic foundry
machine foundations were encountered. These foundations were not apparent or anticipated during the
bidding process.
Warning Fabric
As required by the Beneficial Reuse of Crushed Lead Impacted Concrete permit,a layer of fabric is
required to be placed on top of the material and under the topsoil. This permit requirement was not part of
the bidding documents.
AECOM recommends approval as the quote is acceptable based on a comparison of similar
project costs.The approved budget is on a time and materials basis in the amount of$67,600.00.

Reason for Modification(s)
Unknown Concrete Floor Slab/Gas Line and Valve
During demolition of 43 E.71h Avenue buildings, a second layer of concrete floor slab was encountered
under the building floor slab. This concrete slab was approximately 8"thick and reinforced. In addition, a
8"diameter natural gas line and valve was identified. This gas line and valve had to be investigated in an
effort to determine if it was decommissioned. This slab and gas line/valve were not apparent or
anticipated during the bidding process.
Unknown Former Foundry Machine Foundations
During demolition of 43 E. 7th Avenue buildings, a second layer of concrete floor slab was encountered
under the building floor slab. Under this second layer of concrete several massive historic foundry
machine foundations were encountered. These foundations were not apparent or anticipated during the
bidding process.
Warning Fabric
As required by the Beneficial Reuse of Crushed Lead Impacted Concrete permit, a layer of fabric is
required to be placed on top of the material and under the topsoil. This permit requirement was not part of
the bidding documents.
AECOM recommends approval as the quote is acceptable based on a comparison of similar
E project costs.The approved budget is on a time and materials basis in the amount of$67,600.00.

Reason for Modification(s)
This facility is part of the Sawdust District Redevelopment area. All the surrounding buildings are already
included in the demolition contract.
AECOM recommends approval as the quote is acceptable based on a comparison of similar
project costs.The approved budget is on a time and materials basis in the amount of$167,000.00.
