PURPOSE: RATIFY PURCHASE OF EIGHT TRUCK VEHICLES TO EWALD
AUTOMOTIVE GROUP PER STATE CONTRACT COOPERATIVE
PURCHASING FOR VARIOUS DEPARTMENTS ($262,476.00)
INITIATED BY: PURCHASING DIVISION
WHEREAS, it has been determined that various departments are in need of
purchasing new and replacement vehicles which includes eight truck vehicles; and
WHEREAS,by participating through the State of Wisconsin Cooperative Purchase
program, staff was able to obtain a more competitive price; and
WHEREAS, section 12-15 of the City of Oshkosh Municipal Code provides that
purchases may be done without the use of formal sealed quotations or bids pursuant to
a contract with any other local, state or federal governmental unit or agency; and
WHEREAS, Ewald Automotive Group holds the State of Wisconsin's Department
of Administration contract for truck vehicles and required placement of the order prior
to March 5, 2020.
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of
Oshkosh that the actions of City officials placing orders are hereby ratified and the proper
City officials are hereby authorized and directed pursuant to Section 12-15 of the Oshkosh
Municipal Code to the purchase of the eight truck vehicles from:

BE IT FURTHER RESOLVED that the proper City officials are hereby authorized
and directed to ratify the purchase of the eight truck vehicles pursuant to the State of
Wisconsin Cooperative Purchase for Vehicles for various departments. Money for this
purpose is hereby appropriated from:

RE: Ratify Purchase of Eight Truck Vehicles to Ewald Automotive Group per State Contract
Cooperative Purchasing for Various Departments ($262,476.00.)
BACKGROUND
In the major equipment section of the 2020 Capital Improvement Program (CIP) the Common Council
allocated funding for new and replacement vehicles. This memo addresses the purchase of eight truck
vehicles identified within the 2020 CIP. These eight vehicles and their respective CIP allocation, state
contract cooperative purchase price and respective CIP A/N# are as follows:

*Requires additional equipment that will be bid out later using the remaining CIP funds for this vehicle.
ANALYSIS
Purchasing has confirmed that Ewald Automotive Group holds the State of Wisconsin Department of
Administration contract (#505ENT-M19-2019VEHICS-00) for truck vehicles.
FISCAL IMPACT
The total dollars allocated in the major equipment CIP for these vehicles is $389,000.00. The total fiscal
impact for all vehicles pursuant to state contract pricing is$262,476.00. These purchases will be charged
to the A/N# listed above. The remaining CIP funds allocated for these vehicles will be used to purchase
supplemental equipment for some vehicles as noted above. Supplemental equipment will be bid out as
needed and may include lift gates, plows, stainless steel dump bodies, tool box storage, floor mats, etc.

RECOMMENDATION
Section 12-15 of the Municipal Code provides that subject to approval of the City Manager, cooperative
purchases pursuant to a contract with any other local, state or federal governmental unit or agency may
be made without following a competitive bidding or quotation process. If these state contract vehicles
purchases were done separately, per Section 12-15 their purchase would only require approval of the
City Manager followed by a report to the Common Council. However, given that these vehicles had to
be ordered before March 5, 2020 to qualify for state contract pricing,they were all purchased at one time
with a cumulative purchase of $262,476.00 which, under Section 12-15, requires Common Council
approval. In consideration of this, and in accordance with Section 12-15 of the Municipal Code and with
approval by the City Manager, Purchasing recommends the Common Council ratify this purchase
pursuant to the State of Wisconsin Cooperative Purchase for Vehicles for various departments to Ewald
Automotive Group, 2570 E. Sumner Street, Hartford,WI, 53027 for$262,476.00.
