Property Owner: Jamie Hudack Action(s) Requested: The petitioner is seeking approval of a three -lot land division/Certified Survey Map (CSM) from one existing lot located at 4701 County Highway S, approximately 0.5 miles northwest of County Highway Y and the Oshkosh city limits. The CSM will also officially dedicate right-of-way along County Highway S. Sizes of the proposed lots and right-of-way dedication are as follows: Lot 1 = 469,813 sq. ft. (10.785 acres) Lot 2 = 435,967 sq. ft. (10.008 acres) Lot 3 = 436,534 sq. ft. (10.021 acres) Right -of -Way Dedication = 38,214 sq. ft. (0.877 acres) Applicable Ordinance Provisions: Land division criteria are located in Section 30-441 of the City's Subdivision Regulations. The parcel contains a single-family farmstead dwelling with several agricultural accessory structures occupying four acres of the parcel. The remainder of the land is used primarily for agricultural purposes. The surrounding area consists of agricultural uses to the north, west, south and east, personal storage to the northeast, and a scattering of single family uses to the northwest. The parcel is zoned General Farming District (A-2) administered by the Town of Oshkosh and is consistent with the current use. The A-2 district permits various agricultural uses and light residential development. Proposed Lot 1 is located at the northwesterly portion of the property and contains the farmstead and agricultural buildings except for a shed. The lot is irregularly -shaped but does meet the Town's minimum requirements for width, depth and area. Lots 2 and 3 are also irregularly -shaped and meet the Town of Oshkosh's minimum lot size requirements in regard to width, depth and area. Proposed Lot 2 contains the aforementioned shed while Lot 3 is currently undeveloped. The application does not state a proposed use for either Lot 2 or 3 but any use must conform to uses allowed by the underlying A-2 District. Any proposed zone change must be consistent with the City's Comprehensive Plan. Access to the site will me made via a single relocated shared driveway located near the center of the property on Lot 1. A cross -access easement is shown on the map which will provide access to Lots 2 and 3. This will negate the need for additional driveways onto County Highway S. The CSM also officially dedicates right-of-way along County Highway S. The dedication consists of a 33-foot wide strip along the south side of County Highway S. This is a typical dedication to create a 66-foot wide dedication common with county trunk highways. The City's Comprehensive Plan designates this area for Conservation Residential. Conservation Residential areas are generally areas located in towns adjacent to the city used primarily for low -density residential purposes. Staff is of the opinion the proposed land division is consistent with the Plari s recommendation. Winnebago County's Farmland Preservation Plan identifies this area as an Urbanizing District. Urbanizing Districts are areas Districts 0 Agricultural District 0 Vilage Center District 0 Urbanizing District F—I Urbanized District ITEM I — 3-Lot Extraterritorial Land Division/CSM - 4701 CTHS— Town of'Oshkosh Paqe 2 in close proximity to urbanized areas with available transportation and utility infrastructure. The land is not enrolled in the Farmland Preservation Program through Winnebago County. The Department of Public Works has reviewed the proposed three -lot Certified Survey Map and noted that the WI Department of Natural Resources has mapped wetlands and wetland indicator soils per the DNR Surface Water Date Viewer website. The Department of Public Works is requesting that any mapped wetlands be shown on the final CSM. RECOMMENDATION/CONDITIONS Staff recommends approval of the three -lot land division/Certified Survey Map at 4701 County Highway S as proposed with the following condition: 1. Show any delineated wetland areas on the final Certified Survey Map.
