In 2017, after Congress repealed the Affordable Care Act’s (ACA) tax penalty for not
having health insurance, Texas and 19 other states filed a lawsuit challenging the
constitutionality of the individual mandate, and the entire ACA, in a Federal District
Court. One year ago, the judge in that case declared the entire ACA unconstitutional in
a decision based on reasoning that legal scholars largely agreed was deeply flawed.
This week, the 5th U.S. Circuit Court of Appeals upheld the District Court’s finding that
the individual mandate is unconstitutional, but remanded the case back to the District
Court to clarify whether the rest of the ACA can remain in place.
Although the Appeals Court decision represents a threat to affordable coverage for 100
million Americans with pre-existing conditions, many of whom are older adults age 50-
64, the ACA remains the law as the case continues to make its way through the courts.
