ITEM I: TWO -LOT LAND DIVISION/CERTIFIED SURVEY MAP AT 2625 RYF ROAD
GENERAL INFORMATION:
Applicant: Paul Nordwig, Omnni Associates

Action Requested:
Two -lot land division/certified Survey Map from one existing 3.063 acre parcel. Sizes of the
proposed lots are as follows:
Lot 1=101,554 square feet (2.331 acres)
Outlot 1 = 15,948 square feet (0.366 acres)
Applicable Ordinance Provisions:
Land division criteria are located in Section 30-441 of the City of Oshkosh Subdivision
Regulations.
Property Location and Type:
The subject site consists of one 3.063 acre parcel located on the south side of Ryf Road
approximately 800 feet west of Edgewood Lane near the northwest side of the City of Oshkosh.
The site contains a farmstead with accessory buildings, as well as a public access trail running
along the eastern portion of the property. The surrounding area consists of agricultural lands to
the north, south and west and a condominium development to the east.

Analysis
The purpose of this land division is to split off a 37-foot strip of land from the eastern portion of
the property containing the pedestrian trail. The city also has a pedestrian easement over the
trail to allow public access to this trail network. The farmstead is currently on the market and
the current owner wanted to remove that potential hindrance. The owner approached the
Edgewood Village Condominium Association to the east to see about acquiring the land with
the pedestrian trail and they agreed. The condo development already contains sections of the
looped trail system.
City staff has reviewed this request and under normal circumstances would not support the
creation of an outlot for the sole purpose of dividing off a pedestrian trail from the parent
parcel. However, knowing the condo association has interest in taking over ownership of the
trail simplifies things. Creating a stand-alone outlot tied to a condo association with several
owners is potentially challenging to track all parties having interest in the property and
determine appropriate property taxes. As a solution, staff will be requiring the outlot be
merged with the existing condo development. The applicant and condo association have been
made aware the outlot must be merged into the existing condo plat which will require an
amendment to the existing condominium plat and declaration. The existing pedestrian
easement will also remain allowing continued access to the public.
The Department of Public Works reviewed the proposed CSM and had no concerns other than
the proposed outlot must be merged into the condo development.
RECOMMENDATIONS/CONDITIONS:
Staff recommend approve of the 2-lot land division/Certified Survey Map at 2625 Ryf Road as
proposed with the following condition:
1. The newly created outlot must be combined with the Edgewood Village Condominium
Plat to the east. The combination will require amendments to the existing condominium
plat and declaration.
