PURPOSE: APPROVE ZONE CHANGE FROM SINGLE-FAMILY 2 DISTRICT
(SR-2) TO CORPORATE BUSINESS PARK DISTRICT — PLANNED
DEVELOPMENT (CBP-PD) FOR PROPERTY LOCATED AT THE
NORTH 1600 BLOCK OF OSHKOSH AVENUE
INITIATED BY: LAKE SHORE DEVELOPMENT OF OSHKOSH LLC
PLAN COMMISSION RECOMMENDATION: Approved
A GENERAL ORDINANCE OF THE CITY OF OSHKOSH AMENDING SECTION 30-32
OF THE OSHKOSH MUNICIPAL CODE PERTAINING TO ZONING DISTRICTS.
The Common Council of the City of Oshkosh do ordain as follows:
SECTION 1. That Section 30-32 of the Oshkosh Municipal Code pertaining to
Zoning Districts and the map therein described is hereby amended by changing the
district character of the described property at north 1600 Block of Oshkosh Avenue from
Single Family 2 District (SR-2) to Corporate Business Park District with a Planned
Development (CBP-PD).
LOT 1 OF CSM 7473 DOCUMENT#1788287 RECORDED AT THE REGISTER OF DEEDS
PLUS PUBLIC RIGHT OF WAY ADJACENT TO SAID LOT EXTENDING TO THE
CENTERLINE OF OSHKOSH AVENUE AND NORTH WESTFIELD STREET, ALL IN
THE 16TH WARD, CITY OF OSHKOSH, WINNEBAGO COUNTY, WISCONSIN.
SECTION 2. This Ordinance shall be in full force and effect from and after its
passage and publication.

RE: Approve Zone Change from Single-Family 2 (SR-2) District to Corporate
Business Park—Planned Development (CBP-PD) District for Property Located at
the North 1600 Block of Oshkosh Avenue (Plan Commission Recommends
Approval)
BACKGROUND
The subject area included in the zone change request consists of a 2.59 acre vacant parcel that
was previously used for residential purposes. The surrounding area consists predominately of
commercial uses as well as Mary Jewell Park to the east and Lakeshore Park and Oshkosh
Corporation Global Headquarters to the north. The 2040 Comprehensive Plan recommends
Interstate Commercial land use for the subject property and Interstate Commercial to the west,
Neighborhood Commercial to the south and Park to the east.
ANALYSIS
The subject site is an L-shaped lot with frontage on Oshkosh Avenue and N. Westfield Street.
The western portion of the site is currently zoned Corporate Business Park - Planned
Development (CBP-PD) while the eastern portion of the site is zoned Single Family Residential
2 (SR-2). The applicant is requesting this zone change to provide uniform zoning for the entire
parcel (CBP-PD) and to have the property zoned appropriately for future redevelopment of the
site. No changes to the site are being proposed at this time. The proposed zoning designation
will be consistent with surrounding zoning to the west and north.
RECOMMENDATION
The Plan Commission recommended approval of the zone change at its January 7,2020 meeting.

GENERAL INFORMATION

Actions Requested:
The applicant requests a zone change from the existing Single Family Residential 2 (SR-2)
District to Corporate Business Park- Planned Development (CBP-PD) District for the property
located at 1650-1660 Oshkosh Avenue.
Applicable Ordinance Provisions:
The Zoning Ordinance does not establish criteria relative to appropriateness of changing zoning
from one classification to another but relies on the Comprehensive Plan and good planning
principles.
Background Information,Property Location and Type:
The subject area included in the zone change request consists of a 112,884 square foot(2.59 acre)
vacant parcel that was previously used for residential purposes. The surrounding area consists
predominately of commercial uses as well as Mary Jewel Park to the east and Lakeshore Park
and Oshkosh Corp. Corporate Headquarters to the north. The 2040 Comprehensive Plan
recommends Interstate Commercial land use for the subject property and Interstate Commercial
to the west, Neighborhood Commercial to the south and Park to the east.

ANALYSIS
The subject site is an L-shaped lot with frontage on Oshkosh Avenue and N Westfield Street. The
western portion of the site (fronting N. Westfield St.) is currently zoned CBP-PD while the eastern
portion of the site (fronting Oshkosh Ave.) is zoned SR-2. The applicant is requesting this zone
change to provide uniform zoning for the entire parcel (CBP-PD) and to have the property zoned
appropriately for future redevelopment of the site. No changes to the site are being proposed at
this time.
Staff is supportive of the request as the proposed zone change will provide consistent zoning for
the lot. As the lot no longer contains residential uses and the 2040 Comprehensive Plan
recommends Interstate Commercial land use,the proposed CBP-PD zoning designation is
appropriate for the site. The proposed zoning designation will be consistent with surrounding
zoning to the west and north.
RECOMMENDATION/CONDITIONS
Staff recommends approval of the zone change from Single Family Residential 2 (SR-2) District
to Corporate Business Park-Planned Development(CBP-PD) District for the property located
at 1650-1660 Oshkosh Avenue.
The Plan Commission approved of the zone change as requested. The following is the Plan
Commission's discussion on this item.
Site Inspections: Report: Mr. Ford, Mr. Hinz,Ms. Palmeri and Ms. Propp reported visiting the
site.

Mr. Slusarek presented the item and reviewed the site and surrounding area as well as the land
use and zoning classifications in this area. The subject site is an L-shaped lot with frontage on
Oshkosh Avenue and N. Westfield Street. The western portion of the site is currently zoned
CBP-PD while the eastern portion of the site is zoned SR-2. The applicant is requesting this
zone change to provide uniform zoning for the entire parcel (CBP-PD) and to have the property
zoned appropriately for future redevelopment of the site. No changes to the site are being
proposed at this time. The proposed zoning designation will be consistent with surrounding
zoning to the west and north. He said staff recommends approval of the zone change from

Mr. Fojtik opened up technical questions to staff.
Mr. Ford asked if the parcel would be subject to the higher building standards with the zone
change.
Mr. Lyons replied affirmatively. He explained the area was always intended to be part of the
Corporate Business Park but the property was not secured yet during the initial zone change
request for the area. He said staff has been working with the applicant on filing a GDP/SIP for
the next meeting and the zone change is the first step to get the project to move forward.
Ms. Palmeri asked if the zone change to CBP-PD would prevent the area from becoming mixed
use.
Mr. Lyons replied it does not prevent it. He explained the Corporate Business Park through the
Planned Development would allow for mixed use type developments.
Mr. Mitchell asked if there were any requirements that would be imposed for properties such as
this when they transition and abut other properties.
Mr. Lyons replied those are handled through the Planned Development process and not during
the zone change requests. He explained there are bufferyard requirements which vary
depending on the type of zoning districts.
Mr. Fojtik opened up the public hearing and asked if the applicant wanted to make any
statements.
There were no statements from the applicant.

Motion by Hinz to adopt the findings and recommendation as stated in the staff report.
Seconded by Mitchell.
Mr. Fojtik asked if there was any discussion on the motion.
Mr. Ford thanked Mr. Lyons for helping him see the big picture of the area.
