PURPOSE: APPROVE PROFESSIONAL SERVICES AGREEMENT FOR
2020/2021 CITYWIDE STORM WATER MANAGEMENT/TMDL
COMPLIANCE PLAN/BROWN & CALDWELL ($165,920.00)

BE IT RESOLVED by the Common Council of the City of Oshkosh that the proper
City officials are hereby authorized to enter into and take those steps necessary to
implement an appropriate professional services agreement with Brown and Caldwell for
engineering services related to the preparation of an update to the citywide Storm Water
Management Plan and a TMDL Compliance Plan in the amount of one hundred sixty-
five thousand nine hundred twenty dollars. ($165,920.00).

RE: Approve Agreement for Professional Services for 2020/2021 Citywide Storm
Water Management/TMDL Compliance Plan/Brown and Caldwell ($165,920)
BACKGROUND
The City of Oshkosh's (City's) storm water discharge quality is regulated under a Wisconsin
Department of Natural Resources(WDNR)issued Municipal Separate Storm Sewer System(MS4)
permit. The permit was originally issued in 2006, re-issued in 2014, and the third permit term
began on May 1,2019. The permit requires the City to conduct various storm water management
programs.
The City's MS4 permit references the pending Total Maximum Daily Loads (TMDL) for Total
Phosphorus and Total Suspended Solids (TSS) Upper Fox and Wolf Basins from the WDNR for storm
water pollution reduction targets. Appendix C of the City's 2019 MS4 permit specifies a schedule
and requirements for the City to meet the TMDL pollution reduction requirements by reachshed.
A reachshed is a segment of a specific watershed.
Engineering Division requested a proposal from Brown and Caldwell to assist in the preparation
of an update to the City's original 2008 storm water management plan and the 2014 update.
Brown and Caldwell was chosen due to their extensive experience with the City's storm water
management plan. The scope of services includes: reviewing the City's existing storm sewer
system map, re-establishing No Control Storm Water Pollutant Load using the most recent
WDNR guidance, re-establishing the City's existing conditions for its TSS and total phosphorus
(TP) loads, evaluating proposed storm water control measures, developing a TMDL
implementation plan,verifying language for the City's construction site erosion control and post-
construction storm water management ordinance, preparing an updated storm water
management plan for TMDL compliance, performing a site plan scale analysis for increased TSS
and TP reduction from new development and redevelopment, and performing field infiltration
testing of Wittman Airport grass swales.

ANALYSIS
Engineering Division staff carefully reviewed the scope of services and the proposed cost, and
found that it is in line with the level of effort necessary to complete the project. The scope of
services was also reviewed and approved by the WDNR.This review was required because these
services are included in the Urban Nonpoint Source and Storm Water Management Grant the city
previously received from the WDNR.
FISCAL IMPACT
Thep proposed fee is not to exceed $165,920. Funding for these services is included in the Storm
Water Section of the 2020 Capital Improvements Program. These services are eligible for fifty
percent(50%) State cost-share,up to the grant award amount of$77,664.
RECOMMENDATIONS
Chapter 12 of the Municipal Code of the City of Oshkosh provides that professional services of a
specialized nature, including engineering services, may be procured without the use of formal,
sealed quotes. I have reviewed the proposal and in accordance with Section 12-16 of the Code,I
am hereby recommending the Common Council approve this agreement.
