HomeMy WebLinkAbout07. 20-38 JANUARY 28, 2020 20-38 RESOLUTION (CARRIED 6-0 LOST LAID OVER WITHDRAWN ) PURPOSE: RESCIND PERSONAL PROPERTY TAXES—LIMELITE STUDIOS ($628.10), HIP HOP SHOP ($117.44), M'S BANQUET & CATERING ($63.83), TANNER GAMES LLC ($1,064.72), and SALES & MARKETING ASSOC ($510.66) INITIATED BY: DEPARTMENT OF FINANCE WHEREAS, the following property taxes were assessed improperly, per Wisconsin State Statutes 74.33 (d) and rescission of the tax due is appropriate: LIMELITE STUDIOS LLC 2200 WHITE SWAN DRIVE OSHKOSH WI 54901-2567 (PP #200317000) 2019 $628.10 and HIP HOP SHOP 1738 N MAIN ST OSHKOSH WI 54901-2918 (PP #201643000) 2019 $117.44 and SCHWAS PROPERTIES LLC (M'S BANQUET & CATERING) ATTENTION: LOIS 601 OREGON ST STE B OSHKOSH WI 54902-5965 (PP #123410000) 2019 $63.83 and JANUARY 28, 2020 20-38 RESOLUTION CONT'D TANNER GAMES LLC C/O ADAM TANNER 874 LORINDA AVE OMRO WI 54963-2021 (PP #201346000) 2019 $1,064.72 and SALES AND MARKETING ASSOCIATES C/O BUSINESS OWNER 3650 CEDAR CREEK CT JACKSON WI 53037-9287 (PP#201544000) 2019 $510.66 NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Oshkosh that the proper City Officials are hereby authorized and directed to rescind the above sums. BE IT FURTHER RESOLVED that the proper City Officials are authorized and directed to seek compensation from the other taxing entities per Wisconsin State Statutes 74.42. Funds for this purpose are appropriated from: Account No. 0100-0908-6469-00000 General Fund —Uncollectible Accounts City of Oshkosh TO: Honorable Mayor and Members of the Common Council FROM: Russ Van Compel, Director of Finance DATE: January 21, 2020 RE: Authorize Rescission of Personal Property Taxes BACKGROUND Per Wisconsin State Statutes, the removal of Property Taxes needs to be authorized by the Common Council. Statutes enumerate six specific conditions under which a rescission is appropriate I necessary. These properties were incorrectly assessed for the tax year 2019. Therefore, the taxes that were incorrectly charged need to be rescinded. The Assessor's staff verified this rescission is accurate and necessary. ANALYSIS Below are the details and reason this is being presented for rescission. In addition, the specific condition as outlined by State Statutes is included: State Statute 74.33 (d)—The property is not located in the taxation district for which the tax roll was prepared. • Personal Property—200317000/Limelite Studios/101 Algoma Blvd Ste J-$628.10 • Personal Property—201643000/Hip Hop Shop/1738 N Main St-$117.44 • Personal Property—123410000/M'S Banquet &Catering/956 W 6th Ave- $63.83 • Personal Property—201346000/Tanner Games LLC/1013 Oregon St A100 -$1,064.72 • Personal Property—201544000/Sales&Marketing Assoc/420 S Koeller St Ste 308-$510.66 FISCAL IMPACT The impact of the above rescission is short term only, since in the years that the taxes are rescinded, the City notifies the Department of Revenue (DOR) of the rescissions and the DOR adjusts the equalized value for the following year to account for the difference. These adjustments are built into the tax rate for all taxing authorities for the following year. RECOMMENDATION Staff recommends that Council authorize this resolution to rescind the above noted taxes as outlined.
