Roll call was taken and a quorum declared present. The minutes of November 20, 2019 and Closed Session November 20, 2019 were approved as distributed. (Belter/Hintz). 19-35 Approve Amendment to TID Development Agreement with Merge,LLC for Redevelopment of Parcels H.I and J within the Marion Road Redevelopment Area Brent Dahlstrom with Merge, LLC stated the extension for the closing is needed to deal with unknown easements found during the title search. It is easier to clear up these easements before the property is transferred so the City can provide clear title. Everything else is on schedule and Merge has received clearance on environmental for the Food Co-Op parcel. The parcel along the river should also have environmental clearance soon. The current schedule for the Food Co-Op parcel is set for ground breaking in May and will be about a 10 month build. Mr. Belter inquired if the other two parcels will need longer than March 31, 2020 to close. Mr. Dahlstrom stated March 31s'is acceptable for closing on all sites. Ms. Palmeri inquired about completion date for the Food Co-Op building. Mr. Dahlstrom stated the completion date will be March 2021. The Food Co-Op will hopefully be able to work on their build out prior to this so they can open in March. Ms. Palmeri questioned the timing for developing the other parcels. Mr. Dahlstrom stated they anticipate starting Parcel J along the river in Fall 2020 or early Spring 2021. This site does have the most environmental issues. Then the parcel with townhomes would be developed last. Mr. Hintz asked about the type of easements found on title. RDA Minutes July 17,2019 Page 1 Ms. Davis stated there are railroad right of way, utility easements, ATC, High Voltage Transmission Lines, and public utility easements. Ms. Brandt stated Merge will work with public works on a new storm water maintenance agreement as well as review with staff the cross access agreement for the site. Mr. Hintz questioned if it is the City's responsibility to get clearance on the easements. Ms. Brandt stated the City has to provide clear title. With these easements, we must examine them and determine the best approach to either clear them from title or work with Merge on how to address them. Ms. Hannemann stated the easement that is giving us most trouble is a 40' ATC easement. Merge and City staff have been working on confirming this is only a 40' easement and not a blanket easement on the property. Motion by Belter to move Res. 19-35. Seconded by Stam. The Middle Village Neighborhood Association held an event to receive input from residents and all were in favor of the concept and will continue to work with the landscape architect and Planning Services to finalize site design details.. The area will be maintained by the Neighborhood Association and funding through the City's Great Neighborhood's Program will be requested for site improvements. The use of the vacant parcel will be assessed and approved by the RDA on an annual basis and the use is consistent with the Middle Village Neighborhood Plan and encouraged by the City's Sustainability Plan. Recommendation The RDA approves the conditional use permit/planned development for a community garden at northeast corner of Central St. and W. Parkway Ave. k 1 ITEM: CONDITIONAL USE PERMIT/PLANNED DEVELOPMENT TO ALLOW FOR PLACEMENT OF A COMMUNITY GARDEN LOCATED ON THE NORTHEAST CORNER OF CENTRAL STREET & WEST PARKWAY AVENUE Plan Commission meeting of June 3, 2014 GENERAL INFORMATION Applicant: Middle Village Neighborhood Association/Coordinator, Lori Palmeri Property Owner: City of Oslilcosh redevelopment Authority Actions) Requested: The applicant is requesting two actions within this petition: A. Conditional Use Permit for a community garden use on a vacant parcel located at the northeast corner of Central Street& W. Parkway Avenue; and B. Planned Development approval for placement of a community garden on a vacant parcel located at the northeast corner of Central Street& W. Parkway Avenue. Applicable Ordinance Provisions: Community gardens are permitted only through the approval of a conditional use permit within the R-2 Two Family residence .Zoning District. The Zoning Ordinance establishes criteria and guidelines for establishment and/or amendment of a Conditional Use Permit in Section 30-11 (D). The site is also Located within a Planned Development Overlay District, which standards are located in Section 30-33(E)(3) of the Zoning Ordinance. Property Location. and Background Information: The subject site is .05 acre/2,324 square foot area located on the northeast corner of Central. Street & W. Parkway Avenue between Central Street and Division.Street within the Middle Village Neighborhood. The area where the garden is being proposed consists of a vacant City of Oshkosh Redevelopment,Authority parcel. The RDA acquired the parcel and demolished the vacant home (formerly 118 W. Parkway avenue) in 2011 using grant funding awarded through the State of Wisconsin Blight Elimination Program. The garden is intended to provide an opportunity for community building in the neighborhood, which is a goal outlined by the Common Council for Oshkosh neighborhoods. The,proposed garden will also provide an option to grow fresh produce for residents who may not have available garden space and provide teaching opportunities for children in the area. Additionally,the use of the vacant lot as a community garden is identified as a goal within the Middle Village Neighborhood Plan which was approved by the Common Council on March 25, 2014 (Resolution 14-233). The community garden, as proposed, would include raised garden beds, a paved brick pathway and a greenhouse with an attached storage shed. The applicant is also requesting additional lighting and neighborhood identification signage be placed on the site. The garden will have rain barrels as a water source utilizing water runoff from the proposed green house/shed structure. Use of the lot would be limited to daylight hours only and would be permitted any day of the week. The proposed improvements meet all bulk and dimensional requirements with the exception of the location of the green house structure and neighborhood identification signage. The proposed signage location will be approximately 10 feet from the sidewalk and would encroach 15 feet into, setback. The proposed green house structure will be 3 feet from the side and rear property and would encroach 22 feet and 4.5 feet into the rear and side yard setbacks respectively. Based on the small lot size and existing 8 foot setback of surrounding residential properties staff believes the proposed green house/shed and signage locations are appropriate, are outside of the vision triangle, and will not cause any vision obstructions. The Middle Village Neighborhood Association recently held an event and received input from residents regarding the community garden use with the majority of the persons in attendance from the Middle Village Neighborhood. The group discussed proposed site design and potential issues related to the garden and all in attendance were in favor of the concept. The neighborhood will continue working with the landscape architect and Planning Services Division to finalize specific site design details. The garden and other areas not used for the garden will be maintained'by the Neighborhood Association, Maintenance will include weeding, mowing, tri-iruning, snow removal and keeping the site orderly. The Middle Village Neighborhood Association anticipates requesting funding through the City's Great Neighborhoods Program to complete site improvements. Item —CUPIPD-Conrinunity Garden-AE corner of Central St.and TV Parkway Ave 2 I The use of the vacant parcel will be assessed and approved on a yearly basis by the RDA. If the RDA, as the owner, feels the applicant is not maintaining the site in a fashion that is compatible fF with the neighborhood„the garden project may be terminated by the RDA. Staff agrees with the applicant that this would be a good use for the'vacant parcel and is consistent with the Middle Village Neighborhood Plant, The City of Oshkosh Sustainability Plan encourages the creation of community gardens and for residents to identify and convert vacant or city-owned land for neighborhood food plots and gardens. The Middle Village Neighborhood Association was proposing to establish a community garden on the site and reviewed photos of the site's existing condition as well as the proposed site plan for the community garden. The garden area was to be used by residents and was identified as a goal within the Middle Village Neighborhood Plan which was approved by the Common Council in March of 2014. She discussed the proposed signage and greenhouse structure to be placed on the site and that the subject site was to be maintained by the Middle Village Neighborhood Association who will be requesting funding from the Great Neighborhoods Program to complete site improvements. Erik May, 622 Franklin Street, stated that he was the resident to the south of the.subject site and he felt the park was an excellent idea as the neighborhood had a large population of children in the area and he also thought that it may provide a method to prevent additional pedophiles being placed in the neighborhood. He did have some concerns with the maintenance of the site and with damage to his property and felt that a privacy fence along the property line in lieu of shrubbery or landscaping would help seclude the green space from his residence. ANALYSIS As part of the City's blight elimination and redevelopment programs, the RDA acquires and demolishes structures. The material is hauled to the landfill and the City pays the tipping fees based on the weight of the load. Habitat has removed many items and materials from structures for their use, which saves the RDA and City in landfill tipping fees at, so their offer and work has saved the City money. Oshkosh TO: Redevelopment Authority of the City of Oshkosh FROM: Allen Davis, Community Development Director DATE: January S, 2019 RE: Housing Stock Improvement Program Update BACKGROUND Earlier this year, the Council directed the City Manager and staff to review existing housing programs and create new programs as needed to improve the housing stock of the City of Oshkosh. After researching similar communities in Wisconsin, the LaCrosse and Green Bay approaches offered the most comparable programs with similar city goals. The August 13, 2019 Council Workshop touched on the acquisition, demolition, and disposition of blighted properties and the need for new housing programs in the City. In early October, staff distributed the attached program descriptions to the Council for review. At the Community Development Department budget session in October,Council and staff had an opportunity to discuss the Community Development Block Grant (CDBG) and Healthy Neighborhoods Initiative (HNI) proposed 2020 Capital Improvement Program(CIP)and 2020 Operating budgets that included the new Housing Stock Programs. Since that time, staff has been developing the brochures and application forms needed to market and administer the new, pilot programs. ANALYSIS The attached information summarizes the programs, funding source, funding requirements, the project locations, and the amount of funding for the additional housing stock improvements. The attachments include: 1. An Acquisition/Demolition Financing matrix — this matrix follows the acquisition/disposition policy and identifies the funding proposed. This expansion of the acquisition/demolition program would increase the number of scattered site blight removal projects from about 4 - 6 projects per year to 10 — 12 projects per year. A grant program to assist in the construction of new single family houses on the acquired parcels after the pre-existing structures are demolished, 2. A Loan program for code compliance program (based on the City's Strategic Plan), and 3. A Loan program for historic restoration and design standards that would help property owners meet historic design standards, as applicable, and property owners meet City design standards, as applicable. FISCAL IMPACT All the new or expanded program budgets have been included in the 2020 Capital Improvement Program and 2020 Operating Budget. The expanded acquisition/demolition program will include $300,000 from the 2020 CIP, and an additional $250,000 from CDBG and $120,000 in HNI funding, for a total of$670,000. The new Housing Stock Programs will use a combination of CDBG and HNI funding. The $50,000 in CDBG funding will be used for the code compliance program and an additional$50,000 from HNI funding for a total of$100,000 for code compliance. The rest of the programs will use HNI funds. The New Construction Incentive for$45,000 will be used on vacant residential parcels. The Historic Restoration and Design Standards Program will use $50,000 from HNI funds. The$300,000 in CDBG Funds are programmed for 2020 out of the approximately$800,000 the city receives from the Federal government. The additional $265,000 in 2020 HNI funds is budgeted out of the$4.4 million balance in the Fund. The City has also budgeted about$500,000 in 2020 HNI funds for existing housing rehabilitation projects. The RDA stills owns the land. The bankruptcy court is still working through the process. Update on Healthy Neighborhood Initiative: City staff is working with Habitat, GO-HNI and the Oshkosh Area Community Foundation to identify the next "Rock the Block" location which is Congress Field Neighborhood Association in May 12th, 14th, and 15th, 2020. They have already identified more than 50 homes for improvements. Update in South Shore Redevelopment Area: 43 E Th Ave/Rec Lanes—Demolition should be starting in January, and will be completed this spring. 700 Block South Main Street—The RDA granted the Option to Dumke/Schultz at their November meeting. 91h Ave. crushing pile - Staff has informed the contractor that the crushing and stockpiling on the site must end in the spring of 2020, when the 91h Ave. site is prepped and all crushing is completed for the site. Sawdust District Planning—City staff continues to work with Houseal and Lavigne and area stakeholders on developing a more specific redevelopment plan for the District. The draft plan was completed in December, 2019, and a public meeting will be scheduled for late January. This item will be placed on a future RDA agenda for action. Morgan District—WPS should be extending power to the riverwalk in conjunction with the outfall construction project. Pioneer Area—Mr. Art Dumke continues to work with City staff to explore multiple development options and funding scenarios. The City drafted a TIF Plan for possible redevelopment and the City Council approved the TIF Plan on September 24, 2019. The site also qualifies for New Market Tax Credits and was included in the recently approved Opportunity Zones. 9th Avenue extension to CN Railroad— Staff has submitted a WisDOT grant application for the street construction from Main Street east to the tracks at the current railroad crossing. Land acquisition and remediation will still be likely required. Undergrounding the overhead utilities has also been submitted for a CIP request. The 9th Ave. extension and utility undergrounding was put in the Favorable Economic Conditions category. Pioneer Drive Riverwalk—Staff is beginning work on the WisDNR application due this spring. Soatworks Property—The Option was granted to Morgan Partners. Update on Marion & Pearl Redevelopment Area: Parcels H, I &J: The City was successful in getting a SAG grant for parcels H and I. The Development Agreement was approved by Council and has been executed. Merge is working on environmental testing and architectural/engineering plans for the parcels. The closing was extended due to title issues with selling the properties. Merge presented their plans and status at the previous RDA meeting. Sawyer Street/Oshkosh Avenue Multi-modal Trail—WisDOT awarded the City $253,000 for extending the trail east from Punhoqua through Rainbow Memorial Park to the Sawyer Street/Oshkosh Avenue intersection in 2021. The City Council recently authorized hiring a contract engineer to work on design, engineering and permitting for the riverwalk through Rainbow Memorial Park starting in 2019.
