Property Owner: Mary Tadych Action(s) Requested: The petitioner is seeking approval of a three-lot land division/Certified Survey Map (CSM) from two existing lots located at the southeast corner of County Highway GG and Gibs Road, approximately 1.25 miles north of the Oshkosh city limits. The CSM will also dedicate right-of- way along County Highway GG and Gibs Road. Sizes of the proposed lots and right-of-way dedication are as follows: Lot 1 =42,808 sq. ft. (0.983 acres) Lot 2= 1,171,626 sq. ft. (26.897 acres) Lot 3=436,555 sq. ft. (10.022 acres) Right-of-Way Dedication=85,817 sq. ft. (1.970 acres) Applicable Ordinance Provisions: Land division criteria are located in Section 30-441 of the City's Subdivision Regulations. The one-acre parcel contains a single-family dwelling and accessory structure while the remainder of the land is used primarily for agricultural purposes. The agricultural portion of the site contains an intermittent navigable stream which has a corresponding 300-foot Shoreland Zoning buffer administered by Winnebago County. The single-family parcel is zoned Rural Residential District (R-1) which is consistent with the current use. The remainder of the property is zoned General Farming District (A-2). Zoning is administered by the Town of Vinland with exception of the Shoreland Zoning adjacent to the intermittent stream. The A-2 district permits various agricultural uses and light residential development. Proposed Lot 1 containing the single family dwelling increases the size of the current parcel to match the historic occupation lines. Due to the right-of-way dedication, the new lot is actually slightly smaller, decreasing from 1.000 acres to 0.983 acres. Lots 2 and 3 meet the Town of Vinland's minimum lot size requirements in regard to width, depth and area. Proposed Lot 2 will continue to have access to County Highway GG and Gibs Road. Lot 3 will have access only to Gibs Road. The application does not state a proposed use for the new 10-acre lot. It is presumed the majority of the lots will continue to be used agriculturally. Current allowable uses are dictated by the underlying zone district. Any proposed zone change must be consistent with the City's Comprehensive Plan. The CSM also officially dedicates right-of-way along County Highway GG and Gibs Road. The dedication consists of a 33-foot wide strip along the south side of County Highway GG and the east side of Gibs Road. This is a typical dedication to create a 66-foot wide dedication common with county trunk highways. The City's Comprehensive Plan designates this area for Rural Residential. Rural Residential areas are generally areas located in towns adjacent to the city used primarily for agricultural purposes and maximum dwelling densities of one unit to 35 acres. Staff is of the opinion the proposed land division is consistent with the Plan's recommendation. The land is not enrolled ' 74 in the Farmland Preservation Programthrough Winnebago County.The Department of Public Works hasreviewed the proposed three-lot Certified Survey Map and did not have any concerns r � �with the land division. RECOMMENDATION/CONDITIONS Staff recommends approval of the three-lot land division/Certified Survey Map at the southeast corner of County Highway GG &Gibs Road as proposed.
