HomeMy WebLinkAboutItem I PLAN COMMISSION STAFF REPORT DECEMBER 3 2019 ITEM I: PUBLIC HEARING: CONDITIONAL USE PERMIT REQUEST TO ESTABLISH AN ADDITIONAL OUTDOOR STORAGE USE AT 3300 MEDALIST DRIVE GENERAL INFORMATION Applicant: Richard Fisher Owner: Smet Investments LLC—Scott Smet Action(s) Requested: The applicant is requesting a Conditional Use Permit to establish an additional outdoor storage use on a previously developed lot. Applicable Ordinance Provisions: Outdoor Storage land uses are permitted only through a conditional use permit in the Heavy Industrial District (HI) as regulated in Section 30-62 (C) of the Zoning Ordinance. Criteria used for Conditional Use Permits are located in Section 30-382 of the Zoning Ordinance. Property Location and Background Information: The 8.92 acre site is located at the southeast corner of Medalist Drive and W. 33rd Avenue,north of 34t"Avenue and is accessed via entrances/exits from Medalist Drive and W. 33rd Avenue. The site consists of a 134,130 square foot industrial building and associated parking area. Currently, it is being leased by Oshkosh Defense for final inspection of vehicles and was previously used by GE Power Systems for light manufacturing purposes. The property is located within the Aviation Industrial Park and the surrounding area consists predominately of industrial uses. The Plan Commission has reviewed and made recommendations on two other outdoor storage areas on this property. At the July 3rd,2018 Plan Commission meeting, the Commission voted to recommend approval of a Conditional Use Permit(CUP) to convert a portion of parking on the northwest edge of the site to secured outdoor storage. The Common Council then voted to approve the CUP at the July 10t",2018 Council meeting. The second outdoor storage area straddles the property line between this Medalist property and the property immediately to the east(under the same owner). The Plan Commission voted to recommend approval of this CUP at the August 71h,2018 Plan Commission meeting and the Common Council voted to approve the CUP at the August 15t',, 2018 Council meeting. The outdoor storage area proposed for this request is the third outdoor storage area proposed for this site. Subject Site: Existing Land Use Zoning Industrial HI Paqe 1 Adjacent Land Use and Zoning: Existing Uses Zoning North Industrial HI South Industrial HI West Industrial HI East Industrial HI Comprehensive Plan Land Use Recommendation Land Use 2040 Land Use Recommendation Industrial ANALYSIS The petitioner is requesting approval of a CUP to convert part of the existing parking area to the southeast of the building to a secured outdoor storage area for Oshkosh Defense products. The owner intends to store government-owned vehicles produced by Oshkosh Defense in a secure area. The storage as proposed will consist of approximately 11,135 sq. ft. (0.26 acres) of paved storage area. Outdoor storage areas exceeding 500 sq. ft. in area require a CUP. The owner plans to remove approximately 24 parking spaces as part of the conversion to storage. The storage lot will not increase the amount of impervious surface area or paving footprint on the site. However,the petitioner and tenant have changed the scope of work proposed under this CUP request a number of times. Staff will require that the petitioner submit a revised site plan showing all property lines with existing and proposed parking calculations to ensure that the loss of parking does not render the site non-compliant with current ordinance standards. The fencing originally proposed as part of the initial application was 8' solid fencing that complied with the standards. The current site plan shows fencing around the storage area, but the storage area is not completely fenced off from the access area to the east of the main building. Outdoor storage areas must be completely fenced off and separate from access and parking areas. The intent is to avoid "spillover" and storage of materials in areas not originally designated as outdoor storage. The petitioner will have to submit a revised site plan to Department of Community Development staff as part of the Site Plan Review process. Access/Traffic/Vehicle Circulation The enclosed storage area should not affect vehicle circulation for the publically-accessed areas of the site as the storage area does not obstruct access to the existing parking areas. The petitioner intends to secure the area behind the building(to the building's east)with 8' tall solid security fencing (in tandem with this CUP request for outdoor storage) to control access to the drive and storage areas at the rear of the building. The existing parking area would lose approximately 24 stalls with the conversion to outdoor storage. The applicant will have to submit parking calculations for the site as part of the Site Plan Review process. Staff will have to ensure that the site is code compliant and that the loss of parking will not render the site non- code compliant. Landscaping Due to the location of the proposed storage lot to the southeast of the building, additional landscaping is not required as part of this CUP request. Outdoor storage spaces are not subject to the same landscaping requirements required of new and reconstructed parking areas. The outdoor storage lot is away from the Medalist Drive and W. 3411'Avenue street frontages. There is also no additional paved area proposed so there are no ordinance requirements for new landscaping. Lighting The petitioner is not proposing any changes to the existing lighting on the site. Signage No sign plans were submitted and the applicant is not proposing any changes to the on-site signage. Building Facades No changes are proposed to the existing building facades as part of this Conditional Use Permit. Storm Water Management/Utilities The petitioner has not submitted erosion and grading plans. The petitioner is converting part of the existing parking area to outdoor storage and is not disturbing or altering the impervious or pervious surface areas on the site. As long as the petitioner does not alter the impervious surface area on the site,no storm water requirements are triggered. The Department of Public Works (DPW)would still review the request to ensure there are no concerns from a DPW perspective. Item I—CUP/Outdoor Storage—3300 Medalist Dr. 3 Paqe 3 Conclusion Staff is in support of the proposed outdoor storage area as the use should not be detrimental to the surrounding area, provided that the work will not alter any access drives or traffic patterns around the site and that the required solid (at least 90% opaque) 8' tall screening (fencing) is installed around the storage area. If the applicant submits the materials required for Site Plan Review and complies with the conditions listed below, staff does not have concerns with the CUP request. RECOMMENDATION/CONDITIONS In its review and recommendation to the Common Council on an application for a Conditional Use Permit, staff recommends the Plan Commission make the following findings based on the criteria established by Chapter 30-382 (F)(3): (1) Is in harmony with the Comprehensive Plan. (2) Would not result in a substantial or undue adverse impact on nearby property, the character of the neighborhood, environmental factors, traffic factors, parking, public improvements, public property or rights-of-way, or other matters affecting the public health, safety, or general welfare. (3) Maintains the desired consistency of land uses, land use intensities, and land use impacts as related to the environs of the subject property. (4) The conditional use is located in an area that will be adequately served by, and will not impose an undue burden on, any of the improvements, facilities, utilities or services provided by public or private agencies serving the subject property. (5) The potential public benefits outweigh any potential adverse impacts of the proposed conditional use, after taking into consideration the applicant's proposal and any requirements recommended by the applicant to ameliorate such impacts. Staff recommends approval of the proposed Conditional Use Permit for an outdoor storage area at 3300 Medalist Drive with the findings listed above and the following conditions: 1. The outdoor storage area must be completely enclosed by 8 foot tall solid (at least 90% opaque) fencing. If fencing changes from the product originally proposed to staff and reviewed, applicant shall submit revised fencing specifications/details to staff for Department of Community Development review. 2. Petitioner shall submit a revised site plan for Department of Community Development review. 3. Petitioner shall submit a revised narrative for Department of Community Development review. 4. No changes shall be made to the existing access drives leading to the site from Medalist Drive or W. 33rd Avenue.
