OUTDOOR STORAGE USE AT 36 E. 101'AVENUE
GENERAL INFORMATION
Applicant: Vinton Construction Company
Owner: Sadoff Iron and Metal Company
Action(s) Requested:
The applicant is requesting a Conditional Use Permit to establish an outdoor storage use on a
previously developed lot.
Applicable Ordinance Provisions:
Outdoor Storage land uses are permitted only through a Conditional Use Permit in the Heavy
Industrial District (HI) as regulated in Section 30-61 (C) of the Zoning Ordinance. Criteria used
for Conditional Use Permits are located in Section 30-382 of the Zoning Ordinance.
Property Location and Background Information:
The 3.7 acre site is located on the east side of N. Main Street with frontage along E. 91h Avenue
and E. 101"Avenue. The site consists of an approximately 56,993 sq. ft. industrial building
(Sadoff Iron and Supply) and associated gravel parking/storage area to the rear (east) of the
building. The surrounding area consists of a mixture of commercial and industrial uses.

ANALYSIS
The petitioner is requesting approval of a Conditional Use Permit to use the existing gravel area
to the east of the building for recycling of construction materials such as concrete and asphalt.
According to the applicant the raw material will be stockpiled and processed into base course

material used on construction projects. The outdoor storage area will exceed 500 sq. ft. in area,
therefore, it will require a Conditional Use Permit.
The proposed storage area was previously used to stockpile and stage various metals for
recycling and the area is enclosed with chain link and slatted fencing. The applicant (Vinton
Construction) is currently storing their materials on the lot immediately to the north of the
subject site, across E. 91h Avenue. According to the applicant, the traffic operations of trucks
entering and exiting the site for delivery of material will be similar to previous operations.
Staff is in support of the proposed outdoor storage use on a temporary basis and is
recommending a condition that the materials must be removed from the site within two (2)
years. Staff is also recommending a condition that the storage area be completely enclosed with
S' tall solid fencing, per screening requirements for outdoor storage land uses.
Based on the applicant's current practices at their existing location, staff is requesting that the
applicant be required to water the site as well as E. 9t''Avenue during crushing operations to
mitigate concerns related to dust. Staff is also requesting that the applicant be required to
remove any debris from the public right-of-way, maintain E. 911, Avenue and repair any
damages caused by truck circulation to/from the site.
The Department of Public Works reviewed the proposal is requesting a condition that storage
be prohibited 10' either way of the storm sewer and water main and minimum 4' tall chain link
fencing be installed to prevent materials from encroaching into the 20' wide area (see aerial
view below).

RECOMMENDATION/CONDITIONS
In its review and recommendation to the Common Council on an application for a Conditional
Use Permit, staff recommends the Plan Commission make the following findings based on the
criteria established by Chapter 30-382 (F)(3):
(1) Is in harmony with the Comprehensive Plan.
(2) Would not result in a substantial or undue adverse impact on nearby property, the
character of the neighborhood, environmental factors, traffic factors, parking, public
improvements, public property or rights-of-way, or other matters affecting the public
health, safety, or general welfare.
(3) Maintains the desired consistency of land uses, land use intensities, and land use
impacts as related to the environs of the subject property.
(4) The conditional use is located in an area that will be adequately served by, and will not
impose an undue burden on, any of the improvements, facilities, utilities or services
provided by public or private agencies serving the subject property.
(5) The potential public benefits outweigh any potential adverse impacts of the proposed
conditional use, after taking into consideration the applicant's proposal and any
requirements recommended by the applicant to ameliorate such impacts.
Staff recommends approval of the proposed Conditional Use Permit for an outdoor storage area
at 36 E. 10th Avenue as proposed with the findings listed above and the following conditions:
1. All materials being stored on site must be removed from the site within 2 years.
2. The storage area must be enclosed with minimum 8' tall solid fencing.
3. The site must be watered during crushing operations to mitigate dust.
4. East 91h Avenue must be watered during crushing operations to mitigate dust.
5. Debris must be removed from the East 911'Avenue public right-of-way
6. East 91"Avenue must be maintained and any damages must be repaired by the
applicant.
7. Nothing may be stored within 10' of the storm sewer and water main and minimum 4'
tall chain link fencing must be installed 10' from the water main on both sides (east and
west) to prevent materials from encroaching into the 20' wide area.
