Potratz Action(s) Requested: The petitioner is seeking approval of a two-lot land division/Certified Survey Map (CSM) from one existing 37.80 acre parcel located at 357 Planeview Drive, approximately 2.5 miles south of the city limits. Sizes of the proposed lots are as follows: Lot 1 =697,630 sq. ft. (16.02 Acres) Lot 2=948,964 sq. ft. (21.78 Acres) Applicable Ordinance Provisions: Land division criteria are located in Section 30-441 of the City's Subdivision Regulations. The property is currently used primarily for agricultural purposes and contains a residential farmstead and agricultural outbuildings. The property has split zoning with the western 900 feet being zoned General Agricultural District(A-2) and the eastern 300 feet zoned General Business (B-3). A 250-foot wide section of the eastern portion containing the house and accessory structures is also zoned A-2. Per the submitted application, the purpose of this land division is to allow the owner to create a ten acre parcel (Lot 1) to be transferred to his son for construction of a new residence. The application states the remainder of the property(Lot 2)will continue to be farmed. Proposed Lot 1 is sized at approximately 565 feet wide by 1,235 feet deep and 16.02 acres in area. Lot 2 is proposed to be approximately 755 wide by 1,256 feet deep and 21.78 acres in area. Both lots meet minimum size requirements in the underlying A-2 district. The proposed land division will not immediately alter the existing land use patterns in the area. At this time, the majority of Proposed Lot 1 and all of Lot 2 will continue to be used for agricultural purposes. The Comprehensive Plan recommends interstate commercial uses between Interstate 41 and Planeview Drive;the proposed land division is not in conflict with the plan's recommendation as the divisions meet requirements for commercially-zoned property. The majority of the existing base zoning on Lot 1, General Agricultural District (A-2), dictates what uses are allowed regardless of the Comprehensive Plan's recommendation. The A-2 District allows for development of a single-family residence on a minimum five acre parcel. The Department of Public Works has reviewed the proposed two-lot land division and did not have any concerns with the land division. RECOMMENDATION/CONDITIONS Staff recommends approval of the two-lot land division/Certified Survey Map at 357 Planeview Drive as proposed.
