HomeMy WebLinkAbout16. 19-513 SEPTEMBER 10, 2019 19-513 RESOLUTION (CARRIED 6-0 LOST LAID OVER WITHDRAW ) PURPOSE: APPROVE AMENDMENT TO 2019 CIP BUDGET FOR LAKESHORE RIVERWALK PROJECT $150,000.00 (CONTRACT 19-10) INITIATED BY: PUBLIC WORKS DEPARTMENT WHEREAS, the Common Council has adopted the 2019 CIP Budget, which is on file in the Office of the City Clerk and available for public inspection; and WHEREAS, substandard and contaminated soils were found beneath the parking lot of the former the Lakeshore Golf Course, and a change order is needed to Contract 19- 10 to fund the additional costs associated with removal of the subject soils; and WHEREAS, due to bid prices there are no available contingency funds remaining for this project; and WHEREAS, the change order for soil removal is needed in order to keep the project on schedule for a Fall 2019 opening; and WHEREAS, staff is requesting additional contingency funds in the event that other costs may come up over the remainder of the project and additional change orders may be necessary in order to complete the project on time; and WHEREAS, it is necessary to amend the 2019 CIP Budget to add up to $150,000 in additional funds for the Lakeshore Riverwalk Project. NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Oshkosh that the 2019 CIP Budget, on file in the City Clerk's Office, is hereby amended with adjustments as listed in attached Exhibit #9; and BE IT FURTHER RESOLVED, that the City Manager is authorized to sign the necessary change orders to keep the project on schedule, with the understanding that the project remain within the revised budget limits and that all upcoming change orders to Contract 19-10 be brought to Council for ratification. 2019 Capital Improvement Program Budget Amendment, Exhibit #9 Agenda Date: 09-10-19 Account Description: Lakeshore Riverwalk Project Account#: From Account: 03210410-6801-04814 (18-14 — Oshkosh Avenue Area Redevelopment Infrastructure Improvement) To Account: 0581-1040-7216-67901 (TIF 35 - Oshkosh Ave Corridor Lakeshore Riverwalk I-41-Punhoqua) Explanation: Additional contingency funds needed for soil removal and other possible costs to keep project on schedule Dollar Amount: $150,000 of Oshkosh TO: Honorable Mayor and Members of the Common Council FROM: Allen Davis, Community Development Director DATE: September 5, 2019 RE: CIP Budget adjustment of$150,000 for Lakeshore Riverwalk Project, Contract No. 19-10 BACKGROUND The City included the construction of the Lakeshore Riverwalk from I-41/Tribal Heritage Trail east to Punhoqua Street in the proposal to Oshkosh Corporation for their Global Headquarters project. Since then, the City has obtained a $793,000 grant from the Wisconsin Department of Natural Resources for the construction of a riverwalk. Oshkosh Corporation also made a $600,000 donation toward the construction of the riverwalk. The City awarded a construction contract to Payne and Dolan for$1,232,621.00 earlier this summer. Since that time, construction of the riverwalk has commenced, unfortunately, several soil related conditions will result in additional construction costs. The proposed $150,000 Budget Amendment is in anticipation of the Change Orders that are expected. Since construction is underway, the Budget Amendment will allow staff to direct work to continue and complete the riverwalk as planned, and Council will still have the opportunity to ratify any Change Orders once final costs are determined. ANALYSIS The total scope of the project includes the construction of an asphalt trail from the I-41 right of way east to the terminus of Punhoqua Street. The riverwalk design is an asphalt trail with lights and benches. Once construction began, the riverwalk excavation revealed several soil issues that were not included in the original bid specifications: • Petroleum impacted soils were uncovered in the old parking lot and it is estimated that 20 truckloads of contaminated soil will need to be hauled and landfilled to continue construction of the riverwalk. The unanticipated land fill tipping fees must also be paid. • Fill materials uncovered large chunks of concrete that must be excavated and hauled away. The City would intend to crush the concrete for future use,but the excavation and haul costs were not included in the original bid. • A sink hole was uncovered and additional excavation and fill material was required to provide a stable base for the riverwalk. • Additional archeological supervision due to the soil excavations. In order for the construction of the riverwalk asphalt trail to proceed and still be completed by October 1, 2019, the contractor will need to perform all the work in the next 2 weeks. Work is currently stopped until these issues are resolved. Once the additional work is complete, staff and the contractor will be able to tally the costs of the additional work. The bridges on the west end of the project still have a long lead time and will not be installed by October 1st. It is anticipated that the bridges would still be installed this fall. The WisDNR will also require additional testing and possible remediation of the remaining un- excavated petroleum-impacted soils, but that work will not be done as part of the riverwalk construction. There is no cost estimate for this additional work at this time. The City will be required to investigate the extent of the petroleum contamination, determine how best to remediate the environmental conditions, and then remediate the site. An environmental engineer will be required for all phases. AECOM is currently only doing what is necessary to keep the riverwalk project on schedule. The additional investigation and remediation work will be brought back to Council for future consideration. FISCAL IMPACT The City funding for the Lakeshore Riverwalk project comes from the 2019 Capital Improvement Program. In addition to the WisDNR grant funds and the Oshkosh Corporation donation, the City's share of the funding is$200,000, and was funded,from the Lakeshore land sale proceeds. The proposed $150,000 Budget Adjustment would be funded by General Funds that were saved on the Oshkosh Ave. /Koeller St. /Westfield St. street project that was also part of the Oshkosh Corporation project. RECOMMENDATION The Council approves the $150,000 CIP Budget Amendment for the Lakeshore Riverwalk project due to soil conditions. Submitted, Approved: 1/114,tfiP45 Allen Davis Mark A.
