HomeMy WebLinkAbout10. 19-477 AUGUST 27, 2019 19-477 RESOLUTION (CARRIED 7-0 LOST LAID OVER WITHDRAWN ) PURPOSE: APPROVE FUNDING CONSENT & ACKNOWLEDGEMENT AGREEMENT WITH WISCONSIN EMERGENCY MANAGEMENT INITIATED BY: OSHKOSH FIRE DEPARTMENT BE IT RESOLVED by the Common Council of the City of Oshkosh that the proper City officials are hereby authorized and directed to the approve the funding consent and acknowledgement agreement with Wisconsin Emergency Management to provide for future participation and reimbursement for training, exercises and equipment related to participation by the Oshkosh Fire Department with the Wisconsin Task Force 1 team project. BACKGROUND The purpose of this Funding Consent and Acknowledgement is to set terms by which Wisconsin Emergency Management (W.E.M.) shall retain annual Homeland Security Grant Program funding on behalf of the City of Oshkosh. Under the Homeland Security Grant Program (HSGP), W.E.M. must allocate 80% of grant funding to local and tribal units of government. The City of Oshkosh would be eligible to receive a portion of this funding for reimbursements. ANALYSIS Under this Funding Consent and Acknowledgment, the City of Oshkosh authorizes W.E.M. to retain HSGP funds each federal fiscal year of funding on behalf of the Wisconsin Task Force 1(TF-1) project until awarded pursuant to the award schedule. This will allow for future participation of the Oshkosh Fire Department with the TF-1 project and to be reimbursed for training, exercises and equipment associated with TF-1. FISCAL IMPACT Execution of this Funding Consent and Acknowledgement will not result in any additional costs or liabilities incurred by the City of Oshkosh. It will not reduce or limit any future Homeland Security grant which may be applied for by the City of Oshkosh or in any way impact future grant opportunities. RECOMMENDATION The recommendation would be that Common Council approve this Funding Consent and Acknowledgement to allow future participation of the Oshkosh Fire Department with the Wisconsin Task Force 1 team (TF-1) through the Wisconsin Emergency Management Agency. Box 14587 • Madison,WI 53708-0587 August 13,2019 Mark Rohloff,City Manager City of Oshkosh 215 Church Avenue Oshkosh,Wisconsin 54903 Dear City Manager Rohloff, I am pleased to inform you that the Oshkosh Fire Department, as one of the agencies that has members on Wisconsin Task Force 1 (TF-1)initiative,is eligible to apply for a share of funding allocated by the Homeland Security Funding Advisory Work Group(FAWG) for training,exercising,planning,and equipment. The sub-grant for this project will be awarded at a later date. Enclosed is an acknowledgement for your signature that authorizes the Wisconsin Department of Military Affairs (DMA), Division of Emergency Management to retain the federal grant funding until it is appropriate to make a sub-grant award to your agency. This acknowledgment is necessary because under 6 U.S.C. § 605 (c),DMA is required to make available at least 80 percent of the state's Homeland Security Grant Program funds to local and tribal government agencies within 45 days of acceptance of the federal award. Alternatively,DMA may retain more than 20 percent of the award beyond the 45 day pass-through period with consent of local and tribal governments. In order to comply with federal law while maintaining administrative processes that promote effective grant utilization and management, I am asking that the local sub-recipients of grant funds sign the consent acknowledgement. Sub-grants for specific projects will be released at a later date as dictated by project needs. A schedule of grant opportunities and description of projects allocated funding is posted on Wisconsin Emergency Management's website. This document is updated each year when the federal grant is awarded to Wisconsin. The consent acknowledgment is effective upon signature by both agencies. This acknowledgment will allow TF-1 agencies to continue to receive funding for projects in accordance with the state homeland security strategy without having to sign a new acknowledgement each year. The agencies that comprise the TF-1 initiative have received funding for nearly fifteen years. I anticipate that will continue to be the case; however, if the Homeland Security FAWG does not recommend funding for the project or if Congress does not make an appropriation for the Homeland Security Grant Program, there may not be funding available to the agencies. The allocation of funds is made each year once federal grant funding is announced. Sincerely, /07 arr�Williams Ph.D. Administrator,Wisconsin Emergency Management Funding Consent and Acknowledgement by City of Oshkosh This document shall serve as a Funding Consent and Acknowledgement between the State of Wisconsin, Department of Military Affairs, Division of Emergency Management (hereafter WEM) and the City of Oshkosh (hereinafter Local/Tribal Government Unit) regarding WEM's retention of Homeland Security Grant Program funds to administer programs on behalf of the Local/Tribal Government Unit. 1. PARTIES.The parties to this Funding Consent and Acknowledgement are WEM and the Local/Tribal Government Unit. 2. AUTHORITY. This Funding Consent and Acknowledgment is authorized under the provisions of Wisconsin Statute § 66.0301. 3. PURPOSE.The purpose of this Funding Consent and Acknowledgement is to set forth terms by which WEM shall retain annual Homeland Security Grant Program (HSGP) funding on behalf of the Local/Tribal Government Unit. Under the Homeland Security Grant Program, WEM must allocate 80% of grant funding to local and tribal units of government. 4. FUNDS RETAINED. Under this Funding Consent and Acknowledgment, the Local/Tribal Government Unit authorizes WEM to retain HSGP funds of up to $775,000 per federal fiscal year of funding on behalf of the Wisconsin Task Force 1 project until awarded pursuant to the published sub- recipient award schedule. Exact allocations are made at the recommendation of the Funding Advisory Work Group, upon release of a new fiscal year of federal funding. The funds retained by WEM with the Local/Tribal Government Units' consent are for those costs expressly identified, as follows: Category Amount Description Planning $25,000 Position support for TF grant work Organization Equipment $200,000 Equipment for training&response for TF 1 Training $400,000 Training for TF 1 members Exercises $175,000 Exercising for TF 1 members TOTAL $775,000 5. LIMITATIONS. Execution of this Funding Consent and Acknowledgement will not result in any additional costs or liabilities incurred by the Local/Tribal Government Unit. It will not reduce or limit any future Homeland Security grant which may be applied for by the Local/Tribal Government Unit or in any way impact future grant opportunities. 6. EFFECTIVE DATE. To ensure continuity with the Wisconsin Homeland Security Strategy's Priorities, Goals and Objectives,this Funding Consent and Acknowledgment is effective from the date of the last signature on this document to June 30, 2024. 7. SEVERABILITY.If any provision of this Funding Consent and Acknowledgement is in conflict with any law,the validity of the remaining terms and provisions shall not be affected. 8. CANCELLATION.This Funding Consent and Acknowledgement will end should Homeland Security Grant Program funding no longer be available to the State of Wisconsin or if a project is no longer funded per the recommendation of the Funding Advisory Work Group. 9. TERMINATION. The terms of this Funding Consent and Acknowledgment, will remain in effect through June 30, 2024. Either party may terminate this Consent and Acknowledgement upon sixty (60) days written notice to the other party. 10. MODIFICATION. This Funding Consent and Acknowledgment may be modified upon the mutual written consent of the parties. 11. APPROVAL AUTHORITY. The Local/Tribal Government Unit's representative certifies by their signature herein that he/she has the necessary and lawful authority to enter into this Funding Consent and Acknowledgement on behalf of the Local/Tribal Government Unit.
