IV. Appeal of fiarry Rhyner, awner of the property located at 217 W.
llth Avenue, proposes to construct a 30' x 48' accessory building
on an existing slab and requests the follawing variances: (1) A
2 1/2' side yard setback is proposed; whereas a 5' side yard setback
is required. (2) A 3' rear yard setback is proposed; whereas a 5'
rear yard setback is required. (3) 1,400 sq ft of building area is
proposed; whereas accessory buildings cannot exceed 800 sq ft.
Ms. Porter stated the appeilant has d�rolished an existing garage and proposes
to wnstruct a 30' x 48' garage on the same site. Three variances are being
requested: one for a side yard setback, one for a rear yard setback and
to exceed the maxiurnun squ�re footage allawed for accessory buildings. Ms. Porter
pointed out there is another large accessozy building south of the property
in qu�stion. A letter was received fran Mr. Garzy Decker, 1113 Oregon Street,
stated he does not oppose the variances. (Said letter on file with these minutes.)
Mr. Harry Rhyner, 217 W. llth Avenue, stated on the east side of the property
there is a chain link fence. If the location of the accessory building is
changed, additional fence wvuld hav�e to be put up. If the proposed accessory
building is moved 5' to the south, it will cut into the U-shaped driveway. He
oantinued the additional sc�uare footage is needed because of vehicles and equip-
ment t1�at need to be stored. He indicated that so�netime in the future, he may
rrovn his ins�ance business intA the riane.
l�ir. Goldthwaite in�rn�ired if the existing foundation will be used?
Mr. Rhyner replied no because there wasn't one. Haw�vpx, he stated he intends
to put one in. He continued the old building was 2-story ar�d 30' x 50' .
Th� pranosed accessory building will be 30' x 48' and one-story.
Mr. Al HimtingtAn, 1920 Beech Stseet, stated this lot is non-confonning
because it i.s residential in a ccarmercial district. He continued that when he
s�poke with Mr. Ehrfurth, he had suggested a 3' rear yard setback instead of
a 0' setback for safety reasons. He continued the praposed structure will be
slightly smller than the old building and only one-story. Mr. Huntington distributed
pictures of the lot in question. (Said pictures on file with these minutes.)
Nh�. Rhyner stated the old building c�ras concave arx3 need.ed to be r�roved. He
oontinued that he has checked with Mr. Reimer, Building Inspector, and no fire
wall will be needed. Mr. Rhyner stated he also spoke with Mr. Ehrfurth, and
after viewing the site, Mr. Ehrfurth felt this location was satisfactory. Mr.
Rhyner believed the praperty is zoned oo�mercial l�c.ause it was used co�rnxci.ally
when it was zoned.

Regarding the findings of fact, Mr. McG,ee felt that by a�proving this appeal,
it fits in with th�e Board's long standing policy to allaw existing accessory
btii.lclings to be replaced in the same location and at the same size.

Mr. Larson stated he w�uld nor�nally oppose an accessozy building of this size.
Hawever, because of the cam�ercial zone he did not feel it wr�uld cause
problerns.
V. Appeal of Mary PinYx�w, c�saner of the propexty located at 928 I�ew�..rd
Court, proposes to construct a 22' x 24' attached garage and
rec�uests the follawing variance: A 5' side yard setback is proposed;
whereas a 7 1/2' side yard setback is requ:i.red.
Ms. Porter stated the appellant proposes to construct an attached garage ar�d
is requesting a 5' side yard setback whereas a 7 1/2' setback is required.
The proposed location of the garage is belaw grade and will be filled prior
to a�nstruction.
Mrs. Mary Piuu�aw, 928 I�wa�l Court, stated a 22' x 24' garage will allow
err�ugh space betw�een her propexty and the garage on the adj acent lot. From
the back of the pro�osed garage to the garage on the adjacent lot, there will be
approximately 16 feet. Mrs. Pinnow indicated she has spoken with the neighbors
who would be irost affected, and they have m objections. Mrso Piru�aw stated
they have considered a 24' x 24' garage and wondered if that wuuld be possible?
Mrs. Hintz inqt�;red what the Board's feelings are on c.hanging the appeal frcen
a 22' x 24' garage to a 24' x 24' garage?
Since adjacent property owners were r�tified of a 22' x 24' garage, IMs.
C,oldthuTaite wondered what their response would be if a larger garage was approved?
Ms. Porter stated that when the planning staff vi.ewed the site, the adjacent
neighbor iridicated they would have preferred to see the garage set fui�-ther
away frcan their garage, but felt the anpeal as stated was "ok" because the
retaining wall would be r�noved.
Aftex further discussion between Board members, Mrs. Hintz felt it wQuld be
safer to r�a.in with what has been reqwested on �he agenda.
Nbtion by Jim Larson to grant the appeal. Dbtion seconded by Harry Luebke.
Motion approved 5-0.
Regarding the findings of fact, Mr. Goldthwaite felt the 2 1/2' deviation fran
the Ordinance is irrelevant and there appears to be m�re t17an enough roam betwoeen
the two garages. H�e did rx�t feel that special privilec�s have been granted
that oth�exs c3�o not already enjoy.
Mrs. H.uitz stated fihe grant;� of this appeal does rx�t affect the health, safety
or welfare of the nei.ghbor2x�od.
VI. Appeal of IaNbnte ScYmiid, awrner of the property locateci at 1410
Central Street, proposes to construct a 20' x 27' accessory
building and requests the follawing variance: A 2' side yard
setback is praposed; whereas a 2 1/2' side yard setback is required.
