ITEM II: COMMERCIAL DESIGN STANDARDS VARIANCE TO ALLOW FACADE
ALTERATIONS USING CLASS IV MATERIALS AT 1026 OREGON STREET

The applicant is requesting approval of a variance from the City's Commercial Design
Standards to allow a facade alteration using Class IV materials at 1026 Oregon Street.
Applicable Ordinance Provision the Variance is being requested:

30-243(C) Commercial buildings shall be predominantly clad in Class I materials.
Class II and Class III materials may be used as accents and trim not to
exceed 50 percent of the total building facade. Class IV materials are
prohibited.
Property Location and Background:
The subject property is a commercial lot located at 1026 Oregon Street and is approximately
4,300 square feet in area. The property contains a 1,035 square-foot single-story commercial
structure built in 1920 according to the City of Oshkosh Assessor website. The surrounding
area consists predominately of mixed residential and commercial uses. The subject property
and immediately adjacent properties are zoned Central Mixed Use (CMU).
The applicants visited Planning Services in July 2019 and discussed their proposal to reroof the
mansard roof of the building. The applicant spoke with staff regarding their proposal to replace
the current wood shingles with ribbed metal paneling. Staff discussed this proposal internally
and determined that Plan Commission review and a design standards variance were required
because the applicant is looking to use ribbed metal panels to clad the mansard roof. These
metal panels are considered a Class IV material by ordinance and are prohibited by ordinance
on commercial building facades.

VARIANCE CRITERIA
The City's Zoning Ordinance establishes design standards for structures within the City with
the overall purpose/intent to:
"regulate the design and materials used for the exterior of buildings and structures within the City so as
to maintain and enhance the attractiveness and values of property in the community."
The standards apply to all new structures and additions and alterations to existing structures
within the City and include standards for facades of these structures. For commercial
structures, the standards require the use of Class I, II, or III materials for facades. Ordinance
prohibits Class IV materials such as ribbed metal paneling. The intent of the standards is to
maintain architectural integrity of the structures and prevent the use of materials that are purely
utilitarian in appearance.
The Plan Commission is authorized to grant variances from the strict application of the
standards when it is determined that one or more of the following apply:
1. The variance will not be contrary to the public interest.
2. Substantial justice will be done by granting the variance.
3. The variance is needed so that the spirit of the ordinance is observed.
4. Due to special conditions, a literal enforcement of the provisions of the Zoning
Ordinance will result in unnecessary hardship.
5. The variance will not allow an alteration of a historic structure, including its
use,which would preclude its continued designation as a historic structure.
ANALYSIS
The applicants proposed the metal paneling for the mansard roof and stated that they were not
aware of the design standards currently in effect. They stated in their application that the
design standard prohibiting the use of Class IV materials does not apply because many
surrounding buildings are constructed of different materials. A number of these buildings
including the one next door have ribbed steel siding similar to what is proposed for this project.

Some of the existing wood shingles are missing,rotted and leaking. Due to these issues, the
applicant plans to remove the wood shingles and install metal panels,new siding and house
wrap. The owner wants a low maintenance product. The applicants intend to use metal panels
that are similar to the ones on the building to the north. The panels proposed are the "Brite
Red" color as listed on the material specifications. The red on the proposed panels would
match the red band used on Red's Pizza and the red awning three doors to the north. The
owner plans to paint the bottom of the building a tan color which the applicants believe would
be complementary to the red paneling.
Staff evaluated the proposed work previously described and the impact on the design of the
building in regard to the purpose and intent of the commercial design standards. The
standards relate to preserving the building's architectural integrity and the potential impact on
adjacent properties, the character and "curb appeal" of the block. In working with the
applicant, staff considered:
• The ordinance sections and their intent;namely to prevent the use of purely utilitarian
materials devoid of architectural interest
• Information provided by the applicant during the process
• Character of the subject building
• Buildings and materials of the surrounding area
After evaluating the petitioner's application and proposed work, staff is supportive of the
variance request. The subject building is a small commercial structure and is not historic in
character or nature. The use of the metal panels will not have a detrimental impact on the
building and staff believes that the panels will hold up over time more effectively than the
wood shingles. As the applicant mentioned, the building immediately to the north employs
metal paneling on its side facade. Other buildings to the north include standing seam metal
roofs or are clad in Class IV materials such as block. Staff does have concerns with the color of
the proposed metal paneling. Staff is of the opinion that the proposed red color will be highly
prominent. Staff would support a more subdued color than the proposed red. At a minimum,
staff recommends that the color of the metal paneling proposed for the mansard roof be
complementary with that of the rest of the facade areas.
RECOMMENDATION
Staff recommends approval of a variance from the City's Commercial Design Standards to
allow facade alterations using Class IV materials at 1026 Oregon Street with the following
conditions and finding.
Conditions:
1.) Metal paneling shall be maintained in a rust-free state throughout the duration of the
roof's lifespan.

2.) Variance is for the mansard roof only and owner/petitioner shall file separate design
standards variance requests for any future facade work where Class IV materials are
proposed.
3.) Applicant shall revise the proposed color of the metal paneling and submit to
Department of Community Development staff for review and approval.
4.) Colors of the proposed metal paneling and the remainder of the building shall be
complementary to one another.
Finding:
The variance will not be contrary to the public interest.

Proposed appearance:
There is no structural change being made.The Cedar shakes, which are rotted, falling off and
deteriorated, will be tore off and hauled away. A steel ribbed panel, 4ft x 5ft, will be installed,
replacing the cedar shakes.The panels are 28 gauge ribbed panels. See Brochure
Justification:
It is felt that the proposed change to the roof will greatly improve the looks of the property. All
the buildings on the block feature different products for siding etc. The bar to the north has
steel panels for siding and roof. It is felt the new panels will harmonize with the looks of the
other buildings.
