PURPOSE: APPROVE APPOINTMENT OF ALTERNATES TO CITY BOARDS
AND COMMISSIONS
INITIATED BY: CITY COUNCIL
A GENERAL ORDINANCE CREATING SECTION 2-36(L) OF THE OSHKOSH
MUNICIPAL CODE AND REPEALING VARIOUS PROVISIONS IN ARTICLE VI,
DIVISION 2 OF CHAPTER 2 OF THE CITY OF OSHKOSH MUNICIPAL CODE
PERTAINING TO THE APPOINTMENT OF ALTERNATES TO CITY BOARDS AND
COMMISSIONS.
WHEREAS, the Common Council of the City of Oshkosh finds that the appointment
of alternates to serve on the City's Boards and Commissions promotes education about
boards and commissions and increased involvement in local government and allows for
establishment of quorums associated with absences by members improving efficiency in
local government; and
WHEREAS, State statutes allow the City to alter the membership of boards and
commissions with limited exceptions.
NOW, THEREORE, THE COMMON COUNCIL OF THE CITY OF OSHKOSH do
ordain as follows:
SECTION 1. That Section 2-36(L) of the Oshkosh Municipal Code pertaining to the
appointment of alternate members for the City's Boards and Commissions is hereby
created to read as follows:
(L) The Mayor, subject to Council approval, may appoint up to two (2) alternates to any
board or commission except the Police and Fire Commission, the Library Board or as
otherwise may be prohibited by law. Without regard to the length of term for other
members of the Board or Commission, the term for each alternate member shall be two (2)
years. Alternates shall be authorized to act in the place of and shall have all authority and
responsibility to act as a member of the board or commission in the absence or upon the
recusal of any regular member of the board or commission.

SECTION 2. Upon adoption of this ordinance creating section 2-36(L) all current
provisions pertaining to alternates within Article VI, Division 2 Boards and Commissions
shall be hereby repealed. This ordinance shall not be interpreted to remove any person
currently appointed as an alternate for any board or commission and such persons shall be
permitted to serve for the remainder of their term of appointment. Upon expiration of any
current term, new appointments shall be made in compliance with this ordinance.
SECTION 3. This ordinance shall be in full force and effect from and after its
passage, publication and placement of the appropriate signage.
SECTION 4. Publication Notice. Please take notice that on August 27, 2019 the City
of Oshkosh enacted ordinance #19-XXX APPROVE APPOINTMENT OF ALTERNATES
TO CITY BOARDS AND COMMISSIONS (A GENERAL ORDINANCE CREATING
SECTION 2-36(L) OF THE OSHKOSH MUNICIPAL CODE AND REPEALING VARIOUS
PROVISIONS IN ARTICLE VI,DIVISION 2 OF CHAPTER 2 OF THE CITY OF OSHKOSH
MUNICIPAL CODE PERTAINING TO THE APPOINTMENT OF ALTERNATES TO CITY
BOARDS AND COMMISSIONS). This ordinance creates a general ordinance allowing
the Mayor, subject to Council approval, to appoint up to two (2) alternate members to
any board or commission in the City, except the Police and Fire Commission and the
Library Board. The ordinance also repeals various provisions currently in place for
individual boards and commissions pertaining to the appointment of alternate members.

RE: Approve Appointment of Alternates to City Boards and Commissions
BACKGROUND
Current ordinances provide for the appointment of alternates to some boards and commissions
while others do not include provisions for alternates. The Police and Fire Commission and
Library Board have strict statutory requirements that do not permit the appointment of
alternates however alternates would be permissible on other boards and commissions. During
Council discussions pertaining to Boards and Commissions it was determined that it would be
beneficial to have the ability to appoint alternates to all boards and commissions where such
appointment is permitted to promote education about and involvement in the City's boards and
commissions as well as to promote efficiency when regular members may be unable to attend
meetings to allow for quorums.
ANALYSIS
The proposed ordinance creates a general ordinance allowing the Mayor, subject to Council
approval to appoint up to two (2) alternate members to any board or commission except as
otherwise prohibited by statute. Alternates would serve a two year term and would be
authorized to act in the place of and have all authority and responsibility of members of the
board or commission in the absence or recusal of any regular board member. The ordinance
repeals existing provisions related to alternates in the various individual board code sections.
FISCAL IMPACT
There is no anticipated fiscal impact to the proposed ordinance change.
