AUGUST 13, 2019 19-455 RESOLUTION (CARRIED 7-0 LOST LAID OVER WITHDRAWN ) PURPOSE: ACCEPT TRAFFIC CONTROL & LIGHTING CONTROL EASEMENT AT OREGON STREET AND WEST 20TH AVENUE INITIATED BY: CITY OF OSHKOSH PLAN COMMISSION RECOMMENDATION: Approved BE IT RESOLVED by the Common Council of the City of Oshkosh that the City hereby accepts an easement for traffic control and lighting control at Oregon Street and West 201h Avenue, per the attached, and the proper City officials are authorized and directed to execute any and all documents necessary for purposes of same. City f Oshkosh TO: Honorable Mayor and Members of the Common Council FROM: Mark Lyons Planning Services Manager DATE: August 8, 2019 RE: Accept Traffic Control & Lighting Control Easement at Oregon Street and West 20th Avenue (Plan Commission Recommends Approval) BACKGROUND The subject site is located on the northeast side of the intersection of Oregon Street and W. 20th Avenue. The easement will be 12' X 6' and located at the northeast corner of the intersection. The easement will occur on currently vacant private property just inside the sidewalk. ANALYSIS The City plans to install traffic control and lighting control cabinets and electric service within this easement. This may also include meters, bollards, wires, conduit and related equipment facilities. Oregon Street in this area consists of a 60' wide right-of-way containing a 4-lane street and sidewalks, however, there is not adequate space within the right-of-way for the installation of the traffic control and lighting control cabinets. Therefore, the City proposes to install this equipment in an easement on private property. The property owner has agreed to the easement. RECOMMENDATION The Plan Commission recommended approval of the proposed traffic control and lighting control easement at its August 6, 2019 meeting. Applicable Ordinance Provisions: N/A Property Location and Background Information: The subject site is located on the northeast side of the intersection of Oregon Street and W 2011' Avenue. The easement will be 12' X 6' (72 sq.ft.) and located at the northeast corner of the intersection. The easement will occur on currently vacant private property just inside the sidewalk. ANALYSIS The City plans to install traffic control and lighting control cabinets and electric service within this easement. This may also include meters,bollards,wires, conduit and related equipment facilities. Oregon Street in this area consists of a 60' wide right-of-way containing a 4-lane street and sidewalks,however,there is not adequate space within the right-of-way for the installation of the traffic control and lighting control cabinets. Therefore, the City proposes to install this equipment in an easement on private property. The property owner has agreed to the easement. The City Attorney's office has drafted the necessary easement documents. The Department of Public Works does not have concerns with the proposal and will work with the property owners to have the appropriate easement documents signed and recorded at the Winnebago County Register of Deeds upon Common Council approval. RECOMMENDATION/CONDITIONS Staff recommends approval of the acceptance of the proposed easement as requested. Item—Accept Easement—Oregon St& W.20`h Ave. The Plan Commission approved of the acceptance of the proposed easement as requested. The following is the Plan Commission's discussion on this item. Site Inspections:Report:Mr. Hinz reported visiting the site. Staff report accepted as part of the record. The city requests the deletion of a portion of officially mapped riverwalk along the south shoreline of the Fox River from Iowa Street to approximately 336 feet east of Oregon Street. Mr. Wiley presented the item and reviewed the site and surrounding area. The City plans to install traffic control and lighting control cabinets and electric service within this easement. This may also include meters,bollards,wires, conduit and related equipment facilities. Oregon Street in this area consists of a 60' wide right-of-way containing a 4-lane street and sidewalks,however, there is not adequate space within the right-of-way for the installation of the traffic control and lighting control cabinets. Therefore, the City proposes to install this equipment in an easement on private property. The property owner has agreed to the easement. Mr.Wiley stated staff recommends approval of the acceptance of the proposed easement as requested. Mr. Fojtik opened up technical questions to staff. Mr.Hinz questioned if the easement would impact the previously approved condo development in that area or any future development of the area. Mr.Wiley said he believes it would not impact future development of the area. Mr. Nau added with the easement being tucked in on the north side of the property, it should not have any conflict with the proposed entrance to the site. He stated he recalled the entrance to the site being centered on W. 201h Avenue. Mr. Hinz pointed out that the entrance can be seen from the aerial photo. Mr. Lyons explained due to the zoning of the site,the site would only be permitted one access drive. He said there is sufficient room to the south of the easement for an access drive. Mr. Fojtik asked for any public comments and asked if the applicant wanted to make any statements. There were no statements from the applicant There were no public comments on this item.
