PLAN COMMISSION STAFF REPORT AUGUST 6,2019 ITEM II: ACCEPT TRAFFIC CONTROL &LIGHTING CONTROL EASEMENT AT OREGON STREET AND W. 201h AVENUE GENERAL INFORMATION Applicant: City of Oshkosh Owner: Vienola Properties, LLC Actions Requested: The City of Oshkosh is requesting acceptance of an easement for traffic control and lighting control cabinets and associated equipment at Oregon Street and W. 201h Avenue. Applicable Ordinance Provisions: N/A Property Location and Background Information: The subject site is located on the northeast side of the intersection of Oregon Street and W 201h Avenue. The easement will be 12' X 6' (72 sq. ft.) and located at the northeast corner of the intersection. The easement will occur on currently vacant private property just inside the sidewalk. ANALYSIS The City plans to install traffic control and lighting control cabinets and electric service within this easement. This may also include meters,bollards,wires, conduit and related equipment facilities. Oregon Street in this area consists of a 60' wide right-of-way containing a 4-lane street and sidewalks,however, there is not adequate space within the right-of-way for the installation of the traffic control and lighting control cabinets. Therefore, the City proposes to install this equipment in an easement on private property. The property owner has agreed to the easement. The City Attorney's office has drafted the necessary easement documents. The Department of Public Works does not have concerns with the proposal and will work with the property owners to have the appropriate easement documents signed and recorded at the Winnebago County Register of Deeds upon Common Council approval. RECOMMENDATION/CONDITIONS Staff recommends approval of the acceptance of the proposed easement as requested.
